Visa Confusion - Partner
Hi All,
Im slightly confused in regards to which Visa is right for my partner.
Im an dual passport holder and are looking to returning to Australia in Oct 2012 after 7 years away from OZ.
At this present time I am engaged to my partner and have been together for 4 years. Now the tricky thing is we will be getting married 1 month before travelling back to Australia.
So which Visa do we go for?

The partner visa is applicable for both married and unmarried de-facto partners.
You would apply for the 309/100 visas offshore (combined visa application: TR become PR after 2 years in Australia)

If you can show that you have been living together for 3 years or more then you should be granted PR rather than having the 2 years on a temp visa first, or if you have been living together 2 years and have a child together.

Would you meet the requirement for a de facto partner visa? That is, have been living together for at least 12 months - with evidence to prove it.
The other option is the Prospective Marriage Visa (fiance visa). However for this your partner would need to make a trip to Australia once their visa is granted and before you get married - it can be a very quick trip, and you can marry outside Australia. Once married you & your partner can travel to Australia, and they can then apply for a spouse visa in Australia (all must be done within 9 months of visa grant). Check here for full details.
