Default subclass 300 to 309, provided agent made the mistake

just wondering that agent be able to change application from subclass 300 to 309, provided agent made the mistake at the time of application 2 weeks ago? or needs to apply new application and fee for 309 partner visa?

If a subclass 300 is lodged and the applicants wed before the 300 is decided, the procedure is to withdraw the 300 and proceed with a 309.
If the applicants were married before a 300 was lodged, the application is invalid.
The minister's delegate might treat the application as a 309, but is not obliged to.
In the wort case the VAC for the invalid application would be refunded, eventually.
