Do I use form 888 when applying for a partner migration (de facto) visa or
the more generic statutory declaration form?

We didn't use either. Just got the people who where writing them to do so on a piece of paper and took them along to the solicitors to be witnessed. They did have to write the following though:

I (persons name) of (address) do solemnly and sincerely declare the following - blah blah blah!!!

I make this solemn declaration conscientiously believing the same to be true and by virtue of the statutory declarations act 1835.

Just got them to fill in the blanks and then to write a glowing report of what wonderful people we are and how much in lurve we are!!

We got our spouse visa through the post on Friday. Front-end loaded by post. Took 25 days from posting this end to receiving back from Oz house in London.

1. Friend should state which one of you they know as a friend and how long they have known you.

2. State that they were introduced to Name as you partner on Date, have known you to be a couple since that date and you began living together in Month/Year.

3. They can include something-general here, e.g. that they socialise with you both on a regular basis, know you to be in a serious relationship, committed to each other etc.

4. Include as much detail as possible giving reference to the times and occasions you went out and socialised etc.


And I make this solemn declaration conscientiously believing the same to be true and by virtue of the statutory declarations act 1835.

Statutory Declaration

1. Write a 3-4 sentence account of how, when and where you first met and how the relationship developed.

2. Write a short paragraph stating when and where you began living together, giving the addresses and dates of places you have lived together since.

3. Write a 3-4 sentence paragraph describing how the household tasks are shared between you.

4. Write a 3-4 sentence paragraph on how you support each other financially, physically and emotionally and when this level of commitment began.

5. Write a 3-4 sentence paragraph describing how you share your house hold expenses, i.e. who pays for what, or if your money is pooled into a joint bank account and expenses are met. From this outline how it works. In this paragraph mention any other joint financial arrangements you have. If you don’t have a joint bank account, you should mention any particular reasons you have not to open one.

6. Write a 1-2 sentence paragraph outlining any reasons you have for not being married (if applicable)

7. Write a 2-3 sentence paragraph about whether you see your relationship as permanent, and a brief outline of your future plans.

8. If you have any further points you wish considered when the decision-maker assesses your relationship, add to this section here.

Form 888 is for use by people making their declaration in Australia.

My partner and I wrote the stat decs in word and took them along with the originals and copies of our documentation.

For 50 GBP I got the 2 stat decs and over 100 pages (a bit excessive in hindsight) certified.

The solicitors added in the correct legal wording and we then had to swear on the bible. This was a full statutory declaration recognised under English law which is what the London High Commission wants of someone declaring in England.

I have have no idea whether the stat decs have to be true to the letter of the law or just the spirit.

My advice is to ring a few solicitors to get prices and get it all done at once.
