Hi,

I'm new to this forum and I'm hoping someone can help.

My fiance and I have been together for 5 years and we are getting married in October this year in Australia. I am Australian and my fiance is from the UK. I have duel citizenship and we currently live in the UK. We are hoping to get a spouse visa for my partner once we are married.

Just over a year ago my partner was diagnosed with a mild form of cardiomypathy. Since being diagnosed he has not had any complications and his condition is being controlled by medication.

I am worried about the health checks that they do and that he wont get his visa because of this condition.

Has anyone had any experience of applying for a spouse visa with cardiomypathy or a heart condition? If so have they been successful/unsuccessful? Does anyone have any tips?

There are a number of posts re health issues and visa's being denied, so your concern is a real one for many people. On the other hand doing your research first gives you the best chance to get an application approved.

In the medical your panel doctor will need the specialist reports and these will either lead to approval with no further information being asked for OR the case officer CO will ask for more documentation.

This is then sent to Medical Officers, MO, in Australia to be determined whether the costs are higher than acceptable to the country, and the CO will say if your case has been approved or if not if you want to apply for a waiver.

Although it appears most people think the waiver is a given for a spouse, many couples have had the waiver denied and had to apply to the migration review tribunal MRT.

My husband and I are in a very similar position to you.

I am Australian and have lived in the UK for 7 years. My husband is British. We got married last year (lived together for 5 years) and are hoping to move to Melbourne this year.

My husband was diagnosed with Arrhythmogenic Right Ventricular Cardiomyopathy 2 years ago.

We are in the process of collecting information to lodge a Partner Visa Application. We have a migration agent - but they don't seem to be particularly familiar with the health requirements. I have been given some information about a company in Sydney that gives advice prior to you lodging your application. I have contacted them for more info.

Melbourne is my home and it is where all my family and our mutual friends are. I can't imagine not being allowed to live there together!

I would also be very grateful for any advice/tips anyone has.

So why have you chosen this agent? Not many agents are experienced in medical cases, but there are a few out there who can help.

Hi, I have a concern as well. Is caesarian birth a medical concern as well? Appreciate any help on this.

I recommend you check out either Peter Bollard or George Lombard, both recommended for visas with health issues. If your agent isn't familiar with health stuff I would change now.
