1. If you apply onshore you need to be in Australia at decision. If
you are going back to England, why not apply at AHC London?

2. When did you last enter Australia on an ETA?

3. If you let yourself become unlawful (eg if you have overstayed the
3 months allowed on an ETA) and then apply onshore you'll end up in a
total mess.

4. You get a bridging visa when you lodge onshore. What type, and
how easily you'll be able to travel depends on your status (lawful or
unlawful) when you lodge your application.

5. You may need professional advice - hire a good agent or contact
IARC, http://www.iarc.asn.au

I am English and have married an Australian citizen in OZ.

I have recently received the Police checks, X-ray completed awaiting medicals.

I am due to fly back to England in June however my application will be ready next week.

Can anyone assist :
1. Is it best to take my application in person to Sydney Dimia office or post or make an appointment?
2. Does the Dimia allow me a temp visa so I do not have to leave the country in June? My current visa is just an ETA - multiple entries (3 monthly).

We have been living together for over a year with me travelling to the UK etc within the 3 months. My current ETA runs out in December 2003.

Any advice will be much appreciated

If you apply for a spouse visa while lawful, you will get a Bridging
Visa A that kicks in when your existing visa ceases. If you last
entered Australia on an ETA that's at the end of the three month
period.

But a Bridging Visa A does not give you the right to travel overseas -
you need a Bridging Visa B for that.

And the bridging visa won't be any use if you leave Australia while
your ETA is still in effect.

You also need to be in Australia when your onshore application is
decided.

If you are planning to travel in the near future, you should get
professional advice - see below. On top of that, processing may not
be quick if you are de-facto rather than legally married and you need
to be onshore whenever it's decided.

If you forget to apply while lawful you'll have an even bigger mess to
deal with - so don't leave it until the last minute.

You can contact IARC if in Sydney or RILC if in Melbourne, or a
similar organisation in your city if elsewhere.

A little knowledge in this area can be very dangerous and many spouses
of Australians have fallen foul of the technicalities, at a
significant cost in terms of both time and money.

Contact DIMIA on 131881 and see if it's possible to make an
appointment. But if you are approaching any kind of time limit to
apply (like the 3 month limit on your stay) then don't wait to be
given an appointment.

I last entered Oz on the 7th March 2003, I hope to have my application ready for the Dima next week. Is the bridging visa granted automatically on receipt of my application?, as I am required to leave the country on the 7th June 2003. I am frontloading the application, to save any messing about, complete with stat decs etc.
Any advise would be greatly appreciated.

I did something very similar. Married in Oz and submitted my application in
person in Sydney. After a couple of hours waiting I was assigned a case
officer who took my application away and told us to come back in an hour.
When we got back we were told that certain items were missing and given 2
weeks to supply them and a bridging visa valid from the date of expiry of my
ETA and which permitted work. Supplied the required items within the 2
weeks and about a week after that one slim envelope and 2 bulky envelopes
landed on my doorstep. Notification of visa and return of evidence.
Bridging visa never even became valid!
