Skilled Independent Overseas Student (On shore)
Who can apply for this? Am I eligible?
Book 6 General Skilled Migration page 18 said
1. Applicant must passs the points test
2. Satisfy basic requirement
3. Must hold satisfactory skill assesment undertaken in 60 point
(unless completed Australian PhD)
ACS assessment said that
"The applicant has a Master of Engineering Science, which has been
assessed as comparable to Australian Masters Degree with a major in
computing"
Does it mean 60 point?
I completed that Master Degree 4 years ago. I am applying this category because my student visa will be expired next March. And I
would like to get a bridging visa for me, my wife and my son (8 months
old), so I dont need to extend my student visa.
Am I right if I can still work 20hours/week on bridging visa?

That is actually what I doubt about. I thought that 6 months is just for exemption of recent work experience, since I can not find anywhere in
the book 6 (General Skilled Migration) which said that I should completed an Australian Qualification within 6 months.

No, I did not complete within the past 6 months. (I completed my

You clearly do not qualify under this subclass because you have not completed an Australian qualification within the last 6 months (in reality, you'll have to lodge your DIMIA application before the 6 months are up).
In fact, you may not even be qualified for any skilled visa, as you presently may not have met the basic requirement of having been employed in an SOL occupation for at least 12 of the last 18 months.

If you're doing an Australian PhD you should be eligible for PR when
you complete it, as long as you apply within 6 months (and pass the
points test of course).
You will only be able to use your ACS assessment if it's still valid
at the time (they normally are only valid for 12 months). However,
with an Australian PhD you may be able to qualify with a 50 point
occupation, and hence can get a Vetassess assessment in a 50 point
occupation.
If your student visa will be expiring just after your course finishes,
you will need to obtain the Graduate Skilled Temporary visa rather
than a bridging visa. You will have full work rights on this.
I advise you to hire a migration agent to help you - it's very easy to
find you're ineligible to apply onshore because there are a lot of
rules that have to be observed.

Yes, this website confirmed that I need to apply within 6 months, after completed a degree. Which means I need to apply under skilled independent (off-shore), which means slower process too

Oh no, that 50 point will not enugh (I need 60), since I lost 5 point from age already, and only got +5 from PhD. But I guess ACS still can
award me 60 after I finish my PhD with 3 years 20h/week work experience, hopefully, havent check this possibility yet. Since this is
a backup plan if my current application refused.

1. Do you realise that site is the South Australian government, not
the federal government.
2. If you apply offshore in November, you'll only find out if your
work experience is acceptable or not 12+ months down the track. If
you're refused (which I think is distinctly possible) it will probably
be too late for you to lodge an onshore application based on your PhD
when you get it.

How exactly does the transfer from the student visa to PR work? I
read about the Skilled-Independent Overseas Student (subclass 880). I
dont quite understand the work experience requirements on it however.
It says I must hold a positive skills assessment in a 60 point skill
level occupation unless I have completed an Australian doctorate
degree. Will this class be of any benifit to me if I just finish a
bachelors degree? If I just finished a BS, would that mean the work
experience requirement is waived? If you have any more information on
this catagory I would appreciate it. Most sites and even the General
Skilled Migration booklet seem to deal with it only briefly. I am
interested in migrating to Australia but I haven't finished a degree,
and have only 1 year of IT work experience. Also, one last question.
Sorry for so many, I just found out about this newsgroup. If I were
to go from the student visa to a permanent resident, how long after I
became a permanent resident would I have to wait before I would be
eligible for any benifits from the government? Thank you very, very
much.
