Hi All,
I have a question. I want to setup a company in Australia. Based on that company I want to apply for the long term visa and/or immigration.
I know that it is possible to setup company and then get a long term visa in almost every country including USA.
But i am more interested in Australia.
[One clarification] I am not looking for IMMIGRATION INVESTOR programme where you invest HUGE sum of money to the country. I am looking to create a company and to apply visa inorder to run and manage it.
I own a company in middle east and i have over 10+ years experience in running computer software company.
Can anyone please guide me.
I will really appreciate it if someone from the valued members can say something.
Thanking you in anticipation.

So you have no visa or residency rights for Australia at present, but you want to set up a company in Australia, just so that you can move here to run it?
Have you had a look at www.immi.gov.au ?

Yes i do not have any type of visa or residency in Australia.
I want to setup a company because i want to run a business there and live there meanwhile running my original company in ME also.
I have seen this link immi.gov.au and can apply as a skilled immigrant.
But my main objective is to setup a company there and not seek employment.
Is there any special category for that or procedure or you still want me to pursue the skilled immigrant procedure.
Please let me know.

I personally have no idea whether your idea is possible, though I suspect if it were that easy to just set up a company then move here to run it, then a lot of people would be doing it! I suggest a consultation with a registered agent.

1) it is more expensive to setup company than to just pay one time immigration fee.
Also it is running cost.
2) state prefers and keep it easy as it create jobs in the country and also revenue in forex and taxes
3) people don't do it because you don't just have create a company and they give you passport in plate. instead you have to show for years that your company is doing good and beneficial to state.
I AM NOT sure on Australia though
Can you please suggest someone ?

Have you looked at a 163 Business investor visa? Or done the visa wizard on the immi site? And if you have already applied for a visa why don't you wait until you are granted a PR visa and open a business then?

Hi Polly and Dorothy,
A few years ago one guy tried what s/he is proposing while onshore but as a sole trader and failed.
My thoughts at the time reading the judgement were that if the business had have been incorporated and set up with an appropriate ownership and management structure it may have worked.
It is not a pathway for those faint of heart and most people prefer to be employees which is why I believe it is not attempted very much.
Cheers,
Les

Not sure why he/she dismissed the DIAC website as only being for skilled migrants.

So it isn't something you can just leap into easily?
In which case I think I was right in suggesting the OP gets professional advice.........

For the general consumer, immi's web site is one of the best of its type, but no substitute for a thorough knowledge of the underlying law for anything but the most straightforward of situations.
The problems arise when applicants misinterpret their situation to be straightforward when it isn't.

Not at all. It requires a very good knowledge not just of migration law, but also business and corporation law. Not to mention more than a modicum of Australian business experience.
I suspect s/he only gave the immi website a superficial look.

I was not trying to be snippy. I am sorry to Polly if she felt that way. I really appreciate her responses and everyone else s responses.
I was just trying to explain why many people do not follow that path.

Now I have another question.
Suppose I go for 175 subclass. I apply for "ICT business analyst" (261111) and everything goes well and I am there.
NOW is there any binding in 175 subclass visa that i can only work as an employee or I can also start my own business there instead?
The visa says: "live and work in Australia on a permanent basis".

You can work as an employee, you can set up a business, you can do nothing at all - it's up to you. There are no restrictions of that sort on a 175 visa.
