Default Scam

Can someone help me with some advice?
Here is my problem:
Two years ago I signed a contract with a immigration consulting
company named "Network Visas Ltd" from Auckland, owned by mr Florea
Mirica. He lied to me about the letters coming from NZIS, he didn't go
on with the contract and so on. It is a long story. He also told me I
could sue him if I wasn't satisfied with his services. This is what I
intend to do, but I need to know where should I make a complain
against him and his company. TIA

One for Jamie Smith who regularly contributes to this site.

There was a thread recently about how to complain to NZAMI - www.nzami.co.nz - about a dodgy consultant. In that case it was one that closed for financial reasons. However, a quick look at their members list does not show Florea Mirica or Network Visas Ltd.

In that case the small claims tribunal in NZ might be the only solution, but that may be difficult unless you are actually in NZ.

Do a search for posts contributed to by Jamie Smith and you might find other similar cases.

Thank you so much for the information provided.
I have already contacted Commerce Commission and Consumer's Ministry.
I will wait for their answer. I am now preparing all the necessary
documentation.

Your details are a bit thin.

I confirm that NZAMI membership is reasonably current until a few days ago, no mention of this agent as NZAMI member, and I think no application in pipeline either.

Apparently with good reason.

If you are in NZ you can try recovery through the Small Claims Court, accessible through your nearest District Court usually. Cost is peanuts. Comes down to presenting your own case in fair detail.

Your other actions are also good steps.

If outside NZ, you can engage a lawyer to pursue your case, but should get a quote in case lawyer's fees are higher than what you can recover.

By all means detail the complaint to NZAMI, even if agent is not a member this might help NZAMI avoid recruiting a poor performer, which will mean the agent does not get to trade off NZAMI brand and hopefully leads to fewer people using him, also deters him from staying in industry.

If this is a case of deliberate fraud perpetrated by the agent in terms of instructing you how to cheat the system, you can discuss the case with NZIS Border and Investigations people.

Otherwise, shop around and get second opinions before going with an agent who does not have an obligation to work professionally.
