Our old visa (139) has expired, our agent is not hopeful but says you never know, we have an excellent supporting statement, however we are expecting a no, but still hoping,

OK, never heard of that one. Presumably the job offer is not one that could be a sponsored visa job?

I have seen RRVs being granted when it appears on paper that it should not be, so I think it could go either way to be honest. Now I am confused about your timeline though, you left in 2009, but when did the visa expire? Just curious really, but the more recently it expired, the better your chances I think.

Checked your profile and the signature box is blank so it looks like you removed it

Perhaps in a moment of despair/drunk/idiot or a combination of all three

I'm just wondered about your timeline; you said you spent two years out of five in Australia and left in Jan 2009, but your PR (or the travel part of it) expired last year, which means it would have started in 2008? Were you on a different visa at the start?

Hi SB
sorry for late reply, we got our visa in 2006, and we moved to Brisbane 9th Nov 2006. We came back to Scotland February 2009.

No probs, I think what is confusing me is how long the travel part of the visa was valid for i.e. what was the last date of entry to Australia? You got the visa in 2006 but it expired this year 2014 which means it was valid for 8 years? Is that right? I was working on the assumption it would be 5 years like the 175.

Hmmm I think you may have some mis-understanding there. Your last entry date for your visa was 2011 based on previous posts, so that was when it expired. You would have been eligible for a 5 year RRV at any point 3 years after you returned to the UK so you're 2 years 9 months out.
Sorry, that doesn't help you, but perhaps your agent is not really explaining it very well.

Slackbloke asked when your visa expired, not how long you have been back in the UK.

You earlier said your visa expired in February? But if you got it in 2006, it would have expired in 2011 and then if you got another one at that point, it will not expire until 2016.

It is a little bit tricky to comment on this thread when you are being so unclear around dates ... did you get a 5 year RRV as you left Australia in 2009?
