Hi All,

We have had our final decision today on our VISA and it wasn't a good one - so to everyone that we've either chatted to, helped or been helped by I'd just like to say good luck and all the best in whatever comes your way.

Me and Sonja will probably be leaving this forum for good now as it will probably just be depressing reading what could have been - which looked far more appetising than the U.K. but you've to make the best with what you have and that is what we will do.

So good luck and Goodbye

Sorry to read that its been refused, don't give up all hope. Are you sure you have tried every avenue, even ones like studying in Oz for 2 years to get a trade on the MODL? Expensive option but could be worth it, I knowI am going to use it as a back-up should my application fail.

Hi,

I'm not sure there are many other avenues to take as my skill has been on the MODL from when we started considering moving to oz about 2 years ago. And i am already qualified to degree level and all that so it looks the end for us as they said that everything was fine apart from the cost of my sons medication.

Is there no insurances you can take out or can you sign a disclaimer or something. I think i have heard somewhere about signing something, get on to one of these agents who specialise maybe they can help.

I am so sorry, there is nothing else I can say we are gutted for you. Perhaps, like lacy suggested, there may be some medical insurance you could take?
I hope there is some way for your family....maybe not today but in the future

Hi Lace

Disclaimer, as you call it, probably relates to temporary 457 visa where sponsoring employer can underwrite any medical costs - then Minister can waive the health objection and grant visa. No such waiver for 136 visas unfortunately. Without knowing anything about Tony and Sonya's son's condition, it looks like maybe after his medical costs have peaked and a clearer prognosis and estimate of future costs could then be put forward, then there may be chance of getting through the medicals - but with this presumably being a few years away, and having to depend on the occupation remaining on MODL etc. etc. - it may be best to completely forget about Australia until nearer that time and then re-assess their prospects.

Unfortunately, some people simply do not qualify to migrate. Either their skills or family connections do not meet the standard, or less commonly, they encounter an insurmountable health problem.

If they have already contacted an agent with a good reputation in medical matters (eg Peter Bollard) and handled their application correctly, then unforunately a refusal from DIMIA is the end of the road.

There is no health waiver available on general skilled visas, and no appeal right for unsponsored offshore applicants.

The only possible glimmer of hope is that if the medical condition is one that will improve over time (or there is a certain fixed treatment cost that will not be ongoing) is that it may be possible to apply again a few years down the line.

Looking at other countries (New Zealand or Canada) may be an option but these countries have migration health requirements too.

Realistically - false hope is worse than none at all and the original posters may be best advised to get on with their lives in the UK. There are many worse places to live in.

While of course they have our sympathy, the often expressed view on this forum that there is always 'something that one can do' is not applicable to everybody.

Really sorry to hear about your visa, but the advice that Tony has given does seem excellent advice.... would it be something you may be able to consider - re-assessing your prospects at a later date??

Thoughts are with you Guy's, it must be a bitter pill to swallow, especially when your thread currenty runs alongside a 'got it' one.

You do exactly what you have said you are going to in that last scentence x have you considered moving elswhere in the UK? there is a possibility Jase & I will get turned down because of a medical issue and we have already decided that if we don't get it, we are moving elsewhere in the country.
