question about visa...

Default question about visa...

Hello,

I have applied for Occupational Training Visa and it is now in process in
Australia, but I will not get it ready untill I should be on my way. So is
it by any means possible to apply for e.g. tourist visa and change it to
Occupational Training Visa after I arrive in Australia? Assuming that I have
all the papers are in order.

1. If you're from Finland you can get an ETA instead of a standard
tourist visa.

2. Where did you apply for your visa? (I presume at a DIMIA office
outside Australia).

3. If you've applied for your visa offshore, you need to be offshore
at time of grant. That often means a trip to Singapore or New
Zealand.

4. Make sure the office dealing with your Occupation Trainee visa
application knows about your proposed travel to Australia and if you
do want your visa granted elsewhere you need to tell them.

5. Most temporary visas are processed quite quickly - why do you
think you'll need to go to Australia first?

6. If you go to Australia on an ETA, you cannot start the work you
plan to do until the occupational trainee visa (subclass 442) is in
your passport.

1. Actually I ment this ETA...

2. Form 913 about Nomination for occupational training is now in process in
the Immigration Department in Australia. If my application is approved, I
will received a 147 application for a temporary (non business) visa.

Then I'm supposed take this form to my nearest Australian Embassy (in
Berlin) --> I'll be issued with a sub class 442 Occupational Training Visa
to enter Australia. This is the part I had planned to do in Sydney after
arrival.

4. How can I do this... is there a form for this or will I just inform
off-the-records.

5. The thing is that I've planned (with my friend) to travel a bit around
Asia (from 13th of Jan to 21st of Feb) before going to Australia. We
allready booked our flights in September. Then there came some delays (not
my fault ) and the visa process started not untill this week. I've heard
that the part of process that is now going on now in Australia might take
even 8 weeks. After that I certainly do not have time to send my passport to
Berlin... So I will have the papers but no sub class 442 Occupational
Training Visa.

6. I am not working in Sydney... I'll be at the University of Sydeny as a
trainee or more like an unofficial exchange student... I will not get payed
of anything...

Why isn't the University of Sydney helping you with your visa
application then?

You've not even applied for a visa at this stage. Once the nomination
is approved, you can apply for a visa at the nearest Australian
embassy, although it's best to do so I would think in a developed
country (Singapore, Auckland etc). You do not need to apply through
Berlin.

If the nomination is approved after you arrive in Australia, you
should be able to apply at a DIMIA office in Australia. You can get
your visa onshore in this case.

Be careful on arriving in Australia - if they think you're planning to
work and haven't got a visa to do so, you can be refused entry.
Ideally you shuld try to get your 442 visa before you arrive.

Actually the University is helping. They are the ones that have sent my
papers to the Immigration Department and told what papers to fill... but as
I said I'm unofficial exchange student.



Have you any idea how long would it take to get the visa lets say from
Singapore? I'm in any case going to visit Singapore two times before going
to Australia and there will be about one month between those visits.



This 442 visa doesn't allow me to work. So it's quite the same do I have ETA
or 442 visa when we talk about working, am I right?

The 442 visa is for workplace based training.
If you're going to be a student, why are you not applying for a
student visa.

I've no idea. And you should not expect the Department to change it's
processing times to suit your travel plans.

You CANNOT work on an ETA, nor can you do the kind of workplace based
training that the 442 visa permits.

I will say once again that there is a risk that if you try to arrive
in Australia on an ETA with an intention to work, you risk having a
problem. From the following page:

and then apply for a work permit in Australia?

If it is your intention to remain in Australia and work you would not
be eligible for a visitor visa as you are not intending a genuine
visit to Australia.

People who arrive in Australia with ETAs or tourist visas who intend
to work risk being refused entry on arrival if the immigration officer
finds out.

You seem to have some fundamental gaps in your knowledge of
Australia's visa system. That's ok in itself, but you (or the
University) should hire a professional for assistance, not try to gain
an incomplete understanding by asking some questions here.

Particularly as what you are trying to do is outside the standard
process.

Because I am not official exchange student, they cannot give me proper
certificates to get student visa. I'm training at a specific laboratory. It
is a bilateral agreement of two professors (one from my school and the other
from Sydney)

I don't expect anything. I was just considering, if one month is long enough
for the process.

Just to clarify myself... So if I have time and 147 application (with proper
attachment), I should be able to get 442 visa from Singapore, not only from
Berlin. Is that correct?

I will have about two weeks between my arrival and my planed start of
training... and start of training can be fixed. So actually I would be
visiting... at first.

Of course there will be a risk. I think the point is how big risk?

You are right in both. I have gaps and I should hire help, but I wanted to
try some cheaper choices first, since I'm just student with student wages.
Therefore I really do appreciate all you have done for me.
