Default Processing time for 138 Visa class

Hi,

My husband and I have applied for the Skilled Australian Sponsered
migration.My brother has sponsered me. Below are the details:

Nov,2004 -Appeared IELTS-Score 6.5(husband)
May,2005 -Skills approved by IEA (60 points)
Sept, 2005 -Filed PR docs.

How long does it take to know if DIMIA has approved this application?

We haven't included my points for Spouse skills.Do I have to appear for
IELTS exam.I have completed by Bachelor Of Engineering in Computer
Science and submitted a certificate from my college confirming that
English is the medium of instruction.

Should I take IELTS even then?

Hi!

Currently 138 subclass visa applications are looking to be about 5 months from Ack to Med/PCC/AoS request. Look at AUSTIMELINE.COM for more info on this. After that it's up to you as to how fast things move - if you do your meds quickly and get your PCCs done then the AoS might be the slowdown. AoS seem to be speeding up a bit (perhaps CentreLink is finally getting the hang of things!), but they can still be an issue if your assurer is not well prepared or you run into income level issues.

As for the IELTS thing, the main question would be were you born and raised in a non-english speaking country? If so then you should likely do the IELTS. You might not have to based on your education being in English, but if DIMIA asks for them later you will just slow down the process.

Not looking too good for 138s at the moment. Tomorrow we will have been waiting 6 months. 6 very long hard months. And DIMIA seem to be going in order. A bunch of 138s were granted visas recently, but hasn't been an AoS request for ages...

We have done PCCs, Meds, and IELTS while we've been waiting, to save time, and hoping we get our request soon to just do AoS, and that that part goes smoothly and quickly.

I second BrianO's advice re IELTS.

Hi,

Thanks Brian and happymum!

We both were literally in bliss because our CO seems to be too positive
to answer any of our queries :p (that appears negative to me though). I
thought I was stupid to have soo many doubts!

Feel relieved that forums exist and people are ready to share
thoughts!

Any idea if this Visa can be applied without an AOS, because our CO
never mentioned about it or probably bcoz my bro does it for us....but
it sounds new to me!

Is it true that 138 Visa class has review rights?

All the best to those waiting for their Visa!! Hope God gives all the
strength to make through the wait period :rolleyes:

The 138 subclass visa has a requirement for a MANDATORY AOS. This means that you must have an assurer and they will need to go through the AOS process via CentreLink. The assurer will be required to provide a bond in the form of a term deposit with a bank and will be financially responsible for any changes you make against CentreLink. Your brother could be your assurer, but it does not have to be a relative. Your brother is your sponsor, and in many cases the same person will also be the assurer. Note that the assurer needs to have a required level of income for the past 2 years to qualify. As the applicant for the visa you will be informed when the AOS is requested (usually at the same time the medicals and PCC are requested), and you will need to forward some information to your assurer (a letter from DIMIA).

As far as review rights go, I assume you mean the right to appeal a visa denial to the MRT? Both the 138 and 139 subclass visas do have this right, which is different from the 136 which I don't think does. This is due to the fact that the 138 and 139 classes are family sponsored. Other family sponsored classes may have this right as well.

Ok Brain,

Probably that must be the reason for my ignorance! :eek:

We have not been requested for the PCC/Medicals or neither the
employment enquiry,since it has only been 3 months since we submitted
the papers for PR.

As per all your advices,I have decided to send our PPC,medicals and my
IELTS score to my CO soon! Once again thanks for all the kind
suggestions :)

It has made a hell of a difference after joining this forum (LOL) !I
never realized that there were so many issues related with migrating.

Oh by the way,

I am going ahead and scaring my Bro about the AOS that he would have to
do soon!! :D ...Hope he doesn't repent for sponsering us.. :p

Any idea how much would this amount be for the AOS? I am not really
sure if my Bro can afford it..else we will have to start thinking of
way for it!

The amount of the AoS would depend on how many people there are in your family unit being assured. If you have just 2 adults (any number of children) then it would be $5000AUS for the bond. If you have any children over age 18 as well as 2 parents then you might be in the mode of needing a second assurer as only 2 "adults" (kids over 18 count as adults) can be assured by 1 assurer at a time. Every additional adult adds $1500 to the AoS bond amount. If you happen to be a single adult (or single with kids) then the bond amount is $3500.

Remember that the assurer's income level needs to meet the CentreLink required levels, which changes also based on how many people are dependent on the assurer and how many people are being assured. The income level test also only counts taxable income for the assurer, not gross income, so if your brother does some salary packaging things that might reduce his taxable income level, so be careful (this is why CentreLink wants to see tax receipts for the past 2 years from the assurer).
