minimum work experience requirements!!
Hi,
Trust me to miss this one, what a mistake.
I posted my application to Adelaide today (28th October 2002) as I
didn't want to miss the 3 years out of 4 work experience minimum,
which I thought applied in my case.
Looking back through the website I understand that with my nominated
IT ASCO Code for which the ACS gave me 60 points, I need to have
worked 12 out of last 18 months - which I haven't, I only have 6
months in my nominated trade in last 18 months - but do have 3 out of
last 4 years experience.
So I assume that the application will be flat rejected? ....B*ll*cks
Could anyone advise if this is generally so, and if so, is there a way
that I can request DIMA to disregard my application - so they don't
dent my credit card for A$1745?
I'm hoping for a miracle (yeah right).

Yes, it will be rejected if you do not have exemption from the recent work experience requirement. But the rejection won't be communicated to you before a long wait for DIMIA to assess your application (which may take months, even more than a year).

In practice, it'll be tough to withdraw an application that has got no reference number - DIMIA would be hard pressed to locate and identify your application without one.
However, to get a reference number, you would have already have your credit card zapped the four-digit amount. So it's a catch-22 situation.

Peter's right. Unless you meet the basic requirement you don't even
get to the points test, for which the 3/4 year requirement applies.
However, if you were working in a different skilled occupation (ie
another occupation on the Skilled Occupations List) then you'll be ok.
Work experience for the basic requirement doesn't have to be in your
nominated occupation, it can be in any skilled occupation.

If you sent the package by courier, you could always try ringing the
courier company and asking them to retrieve it (assuming it's not yet
been delivered) and return it to you.

PS If he's trying for a visa under Skilled Designated Area Sponsored,
he'd be ok with just 6 months work experience (with a 60 point
nominated occupation), provided it was in the last 12 months before
application.
And if he's applying for Skilled Australian Sponsored, changing the
nominated occupation to a 50 point one (which would require a
Vetassess assessment) might also be a feasible strategy.
A migration agent could go through these options in detail.

Yeah, I think I will attempt to request that the application is
withdrawn, also I'll ask the credit card company to block the payment
and ask the courier company to retrieve it.
Hopefully one of those will be effective.

You'll probably find the credit card company won't block payment.
It's a guaranteed form of payment and can't be stopped, unlike a
cheque in the UK.
If the courier company's any good they should be able to retrieve it
provided you get on to them before they deliver it. Otherwise you're
going to have ask DIMIA nicely for your money back, and there's a high
risk they'll say no.

Escape from Alcatraz I think? I had the following email today from
APSC:
"We have received your application for Independent Skilled Migration
on 4/11/02, but are unable to process the payment because you have not
authorised the specific migration fee of $1745 to be charged to your
Credit Card.
If you could please confirm that you authorise the amount AUD $1745 to
be charged to your Credit Card we can continue the processing of your
application.
From the date of this letter you have a 14 day period to submit the
outstanding amount. That is, we require your payment by the close of
business of 19th November 2002.
The date that we receive correct payment/authorisation becomes your
new application date."
So thats sorted then!

If you've kept a copy of the form (as you should have done) then you
should be able to see exactly what you've done on the form.
Good to hear it looks like you won't have to pay - it wouldn't have
served anyone's purpose for your app to clog up the system either if
it wasn't going to be accepted.
