Has anybody had to have medicals carried out for under 18 year old children, living with ex partners, that were not going on the visa with the emergrating parent.

Yes - you have to have their consent and they have to have the full medical. Apparently, as the kids next of kin it is assumed that if their UK parent died, they would go to live with their surviving parent in Oz, so technically you could be refused if they don't pass. Not sure about if you can't get consent though.

Hi Pete and Kate

Exemption exists for Chest X-ray unless was from High Risk TB Country maybe. Medical would be expected to be undertaken unless it was "unreasonable" of DIMIA to insist on this.

To expand a bit:

If you claim difficulty in persuading an ex-partner to allow your child to attend to a medical, the case officers can find it ‘unreasonable’ to require the child to undergo the medical. The case office should not take your word for this and should request evidence e.g.

. Direct contact from the custodial parent to the case officer advising that the medical will not be done

. evidence that you have no access to the child if a court order exists to that effect

. evidence of the attempts to make contact with the custodial parent

. Consent from the visa applicant to contact the custodial parent directly with the custodial parent's phone contact details would be good in the absence of everything else and then the case officer can get the local office to perform a phone check.



Regardless of the parental custodial rights of a visa applicant, under policy, a visa applicant’s dependent children are exempt from undergoing routine chest x-ray if the dependent child:

. is not a visa applicant, ie is a non-migrating dependent child and

. is from a low or medium health risk country and

. is not suspected of having a health condition that might otherwise not meet the health requirement.

. A medical (ie form 26) examination is still required.

We just wrote a covering letter and sent some letters that wee sent to his ex-wife asking her to agree to the medicals, we also got a stat dec saying that we were not taking the children, the children did not live with us and the children did not want to come anyway, also there is loads of family members here willing to look after the children if the mother dies.
I have asked the DIMIA about this and this is the course of action they recommended.

We are going for our meds on our own as relationships with the ex-wife and my partner have totally broke down and he hasn't seen his kids in ages.
