Default Loss of sponsorship for Business Visa

Hi,

Just after some quick advice. There's a good chance that in the near
future the company that sponsored me for my 4 year Temporary Business
Visa may pull out of the sponsorship. I'm currently only 10 months
into it.

Does anyone know what is likely to happen if they do? Will I be told I
have 2 weeks to get out of the country, or have my visa changed to a
tourist visa, or what? Will DIMIA give me any grace to find another
job if someone is willing to take over the sponsorship?

I haven't done anything wrong, but the company are restructuring, and
my position is being merged into another one, so mine becomes
redundant.

If anyone knows anything I'd be grateful for any advice, cause I'm
beginning to panic about having to leave (the last thing I want to
do)!

in the same boat as you re: 457 visa. In essence, you will have approx 30 days from when your company notifies DIMA to leave the country. I would speak nicely to your firm and ask them to hold off notifying DIMA until you can get yourself sorted (be that another job, change of visa or a solid plan to get home).

IT, but the market is dead (esp. in Brisbane). I probably have a
couple of months to sort something.

So can I just get a tourist visa from here, or do I have to do the
journey to NZ to get one?

i dont know about the toursit visa thingey (re: leaving the country) - one would assume that you would have to, to activate it. my contingency plan if my employer pulls the plug is to either hop onto my other halfs 457, or just head back to the UK and earn something other than Australian Pesos !

What you could do if your company is ok about it, is ask them to sponser you for PR. I know that sounds odd, but hang on....

I was on a work visa (4 yr), and as soon as I could I applied for PR.. The company had to put up a thousand dollars I think (Maybe you could pay this for them). Maybe if your company is friendly they can do this this for you, even though they're laying you off. Then you can look for other work.A bit of a scam in other words. As soon as you get that PR, you can work for anyone. ... Just an idea anyway

Your story is why I applied for PR as soon as I could, and I advise anyone who moves here on a work visa.. to try and apply for PR as soon as you can, so if your laid off, you are not beholdent to the company.

Or another idea.... As you probably know there are normally a few immigrant agencies in the cities, you could book an appointment and ask their advice... you never know they might come up with something.

I actually am just waiting to fulfill the criterea needed before
applying for PR. Because I travelled for 10 months before coming to
Oz, I don't yet qualify for the working 12 from the last 18 months. I
needed to get another 2 months behind me before applying! Bugger.

Does this meen reading between the lines, that I am can still apply for PR as I left Australia less then 12months ago and was employed there 2 years, prior to this? ie within the past 18months I have been employed by an Australian Company.

Oz, I don't yet qualify for the working 12 from the last 18 months. I
needed to get another 2 months behind me before applying! Bugger.

What's the immigration category?

Skilled Independent, Skilled Sponsored, or Skilled Designated Area
Sponsored.

And what's your nominated occupation worth (60, 50 or 40 points)?

The answers to those questions determine how much recent skilled work
experience you need (everyone other than recent graduates needs some).

For skilled sponsored (ie if your relative lives in the Sydney,
Brisbane or Perth regions) the work experience requirements are:

If your nominated occupation is 60 points, 12 months in the 18 before
you apply.

If your nominated occupation is 50 or 40 points, 2 years in the 3
before you apply.

Points for work experience are calculated separately.

If you got your work experience in Australia, you must have had a
substantive visa (ie not a bridging visa) allowing you to work.

There are some circumstances where a skilled sponsored applicant may
be better advised to nominate a 50 point occupation rather than a 60
point one because of the different work experience requirements.
Maybe you should talk to a migration agent?

Have they dropped the 3 from 4 years work experience needed when they
did the shake up in July (as well as the 12 from 18?)?

If you're skilled independent with a 60 point nominated occupation no
change at all:

12 months in the last 18 to meet the basic requirement
3 years in the last 4 to be awarded points.
