London AHC - What's going on?
My girlfriend is an Australian PR and needs to obtain "proof of residency"
for my visa application but the London AHC aren't answering their phones or
emails!
What's going on? Panic is setting in!

They've disconnected the Temporary Residence number, at least.
I don't get any replies to email either.
My case officer has been changed too.
I think they are just so overwhelmed by everyone trying to get out of Blair's Britain that they are finding difficulty coping. It's not helped by their top brass asking for different requirements such as the FBI fingerprint identification i/o a State Police Check, IMHO.

Hi Ed,
The deal is that Australian PR holders need to prove that they meet the
definition of Australian Permanent Resident in the migration legislation.
Effectively she needs to be "resident" in Australia for legal purposes.
Best to get some competent advice. This requirement has never been policed
all that strictly in the past for spouse applications but it has had a new
lease of life recently.

The deal is that Australian PR holders need to prove that they meet the
definition of Australian Permanent Resident in the migration legislation.
Effectively she needs to be "resident" in Australia for legal purposes.
Best to get some competent advice. This requirement has never been policed
all that strictly in the past for spouse applications but it has had a new
lease of life recently.

She has lived in Australia since the age of 1, and has only been in London
for the last 2 or 3 years. All of her family are in Australia. Would
things like bank statements sent to her Australian address count as proof of
residence?

Residence is a legal term; I appreciate your comments but you need to get
competent advice. There are a number of agents who visit this site, or you
could try contacting the Immigration Advice and Rights Centre in Sydney, see
www.iarc.asn.au .

'Usually resident' is normally taken to mean her home is in Australia
and her absence from the country is temporary. How this is proved
depends on the facts of the case - as George said, you need to get
some competent advice.
''Usual residence' has not been a criteria for resident return visas
(especially when the 2/5 residence requirement is met) since the mid
1990s. However, the requirement was retained for when PRs want to
sponsor, although enforcement has been sporadic up to now. The new
stringency may be linked to the fact that the Minister is exasperated
by the reluctance of so many PRs (especially British) to take
Australian citizenship.
The issue of 'usual residence' would not have arisen in this case if
the original poster's girlfriend had taken out Australian citizenship
when she lived there.
