The latest processing update email from the Adelaide Skilled Processing Centre as of 14 July 2010 is as follows:

GENERAL SKILLED MIGRATION
ADELAIDE PROCESSING INFORMATION

This is an automated e-mail response which provides updated information on skilled migration applications being processed by the Adelaide Skilled Processing Centre (ASPC). Please do not reply to this email address as this mailbox is not monitored. Contact details for the ASPC are listed below.


IMPORTANT NOTICE
Changes to Priority Processing – 8 February 2010
Direction No. 45 - Order of consideration - certain skilled migration visas

The Migration Act 1958 contains powers by which the Minister can consider and finalise visa applications in an order of priority that the Minister considers appropriate. Departmental officers are required to follow this Ministerial direction, which applies to every stage of visa processing.

The Minister for Immigration and Citizenship, Senator Chris Evans, has set new processing priorities for certain skilled migration visa applications. The direction came into effect on 8 February 2010 and applies to new applications lodged on or after 8 February 2010, and those already lodged or in the final stages of processing, and replaces the previous Priority Processing Direction (No. 42) which commenced on 23 September 2009.

The new priority processing arrangements apply to the following visa programs:
The Employer Nomination Scheme (ENS)
The Regional Sponsored Migration Scheme (RSMS)
General Skilled Migration (GSM)

The following GSM visa subclasses are exempt from the priority processing Provisions specified in Direction 45:
Skilled – Recognised Graduate Subclass 476
Skilled – Graduate Subclass 485
Skilled – Designated Area – Sponsored (Residence) Subclass 883
Skilled – Regional Subclass 887

Applications for these visa subclasses will be processed in the order in which they are received.

The following GSM applications are exempt from Direction 45:
applications that have been remitted by the Migration Review Tribunal for reconsideration;
applications where it is readily apparent that the criteria for grant of the visa would not be satisfied;
applications by members of the family unit of a person who holds a temporary or provisional GSM visa (subsequent entrant applications.
visa applications for a Skilled – Regional Sponsored Subclass 487 visa where the applicant holds a Skilled – Independent Regional (Provisional) Subclass 495visa, Skilled – Designated Area-sponsored (Provisional) Subclass 496 visa, Skilled – Regional Sponsored Subclass 487 visa or Skilled – Regional Sponsored Subclass 475 visa at the time they apply.

The Skilled Migration visa processing priorities

Under the Ministerial Direction, the following processing priorities (with highest priority listed first) apply:
1. Applications from people who are employer sponsored under the ENS and the RSMS.
2. Applications from people who are nominated by a State/Territory government agency under a State Migration Plan agreed to by the Minister.
3. Applications from people who are nominated by a State/Territory government agency and whose nominated occupation is on the Critical Skills List (CSL).
4. Applications from people who are neither nominated nor sponsored under Priority Groups 1,2 or 3 but whose nominated occupation is listed on the CSL.
5. Applications from people who are nominated by a State/Territory government agency whose nominated occupation is not listed on the CSL
6. (i) Applications from people whose occupations are listed on the Migration Occupations in Demand List (MODL); as well as
(ii) Applications from people who are sponsored by family and whose nominated occupation is not listed on the CSL.
7. All other applications are to be processed in the order in which they are received.

Application Processing Times for GSM Applications

Information on application processing times is published on the department’s website at Client Service Charter

If your application is in any of priority groups 2, 3 or 4, it is estimated that your visa application will be finalised within 12 months of your lodgement date. Please note that processing times can be affected by circumstances beyond the department’s control.

If your application is in any of priority groups 5, 6 or 7 and you have applied for an offshore GSM visa or intend to apply for an offshore GSM visa, it is unlikely that your application will be finalised within 3years of the date of the application.

If your application is in any of priority groups 5, 6 or 7 and you applied for an onshore GSM visa or intend to apply for an onshore GSM visa, it is unlikely that your application will be finalised within 2 years of the date of the application.

Please note that your nominated occupation is the occupation you nominated at the time you lodged your application and cannot be changed.

Application processing times are indicative only and are based on the current visa application rate, the current Priority Processing Direction, and the availability of places in the Migration Program.

Please do not contact the department to request your application be exempted from the Minister’s Priority Processing Direction. Departmental officers must adhere to the Minister’s Direction and you will be contacted by the department when your application is allocated to a case officer.

Priority Processing Exemptions

Visa Subclasses 476, 485 and 887 are exempt from the priority processing changes. Applications under these subclasses will continue to be processed in the order in which they were received by the department – the following subclass by application lodgement date identifies cases currently being considered:

Visa Subclass

Skilled – Recognised Graduate Subclass 476
VF 476 (paper): 13 June 2010
VF 476 (e-lodged): 13 June 2010
Skilled – Graduate Subclass 485
VC 485 (paper): 6 August 2009
Skilled – Regional Subclass 887
VB 887 (paper): 7 June 2010

Processing News

INCREASED VISA APPLICATION CHARGES (VACs) – 1JULY 2010

Information on fees and charges is published on the department's website at Fees & Charges - Applications & Forms - Visas & Immigration

When a VAC is changed, the new amount applies to all visa applications received by the department on and after the day the VAC is changed. Therefore if an application will be received by the department on or after 1 July 2010 please ensure that the correct VAC is paid. An application has not been validly made until the full VAC is received.

The ASPC has been advised that the relevant visa charges will increase as follows:

If the first instalment of the VAC payable was previously $AUD230 it will be $AUD235 from 1 July 2010
If the first instalment of the VAC payable was previously $AUD2525 it will be $AUD2575 from 1 July 2010

For GSM applicants liable to payment of a second instalment of the VAC the amount payable will be $AUD3575 for applications lodged on or after 1 July 2010. Applicants are not required to pay the second instalment until requested to do so by the department.


THE TEMPORARY SUSPENSION OF ACCEPTING OF CERTAIN GSM VISA APPLICATIONS LIFTED – 1 JULY 2010


The temporary suspension of accepting of certain GSM visa applications lifted from 1 July 2010. Applications for the following visa subclasses are now accepted as normal:

· Subclass 175 – Skilled Independent (Migrant) visa
· Subclass 176 – Skilled Sponsored (Migrant) visa
· Subclass 475 – Skilled Regional Sponsored (Provisional) visa.


CAPPING AND CEASING OF SPECIFIED OFFSHORE GSM APPLICATIONS LODGED BEFORE 1 SEPTEMBER 2007

NEW SKILLED OCCUPATION LIST (SOL) – 1 JULY 2010.

On 17 May 2010, the Minister for Immigration and Citizenship, Senator Chris Evans, announced the list of occupations included in the new Skilled Occupation List (SOL). The new SOL came into effect on 1 July 2010. Applications lodged prior to the implementation of the new SOL will not be affected. INTRODUCTION THE AUSTRALIAN AND NEW ZEALAND STANDARD CLASSIFICATION OF OCCUPATIONS (ANZSCO) – 1 JULY 2010


ANZSCO is a classification system that provides for the standardised collection, analysis, and dissemination of occupation data. From 1 July 2010 ANZSCO will replace the Australian Standard Classification of Occupations (ASCO) currently used by the department. INFORMATION ABOUT PROVIDING DOCUMENTS

Applicants for General Skilled Migration (GSM) are strongly encouraged to submit supporting documentation electronically. Providing scanned copies of documents reduces postal and administrative delays in receiving and processing information.

GSM processing offices accept scanned copies of original documents (non-certified) provided they are in colour. If you scan documents in black and white, then they must be scanned copies of certified copies. The valid file types for attaching documents are BMP, DOC, DOT, GIF, JPG, PDF, RTF, TXT and XLS.

Information which will assist you in attaching documents to your application or in emailing them to the department is available on the department’s website at:

Attaching Documents to a General Skilled Migration Visa Application E-lodged applications

If you e-lodged this application you are strongly encouraged to attach all the supporting documentation to the application in the web-browser. This is the preferred procedure for providing supporting documents for an e-lodged application.

If for any reason you cannot attach documents in the browser then you can email the documents as scanned attachments to:

Paper lodged applications

My intention was to be helpful & not to make a lengthy post . As senior as I have noticed your posts always carry valuable info and so I expected more from you than just a comment on its length.

I think the CSL list should be there for the applications made before 1st July. Just because the CSL is revoked does not mean there are no more CSL applications in the pipeline. Will be a hard job for DIAC, ( but not impossible though) to change the processing priority for occupations that are in critical demand part of the way through the process - it will definetly create mess as far as reassignment is concerned, considereng th fact that clearing the backlog is their maijor aim.

I have thought (as has the OP) about merging this with the previous updates thread, but having found that one it hasn't been touched since September last year. Hence I think its more logical, with all the changes that have occurred since then, to keep this as the start of a new thread

One of the problems that people had last year was that some email addresses don't always receive the Update from DIAC due to ISP filters, spam filters etc, so posting it on here is actually very useful for some.

Lets try and keep it as an update thread though, if people want to discuss and dissect the contents of the weekly email could they please do it elsewhere.

skilled migration applications being processed by GSM Adelaide. Please do

IMPORTANT NOTICE
Changes to Priority Processing – 14 July 2010
Direction No. 48 - Order of consideration - certain skilled migration
visas

The Migration Act 1958 contains powers by which the Minister can consider
and finalise visa applications in an order of priority that the Minister
considers appropriate. Departmental officers are required to follow this
Ministerial direction, which applies to every stage of visa processing.

The Minister for Immigration and Citizenship, Senator Chris Evans, has set
new priority processing arrangements for certain skilled migration visas.
These arrangements take account of the changes to the Skilled Occupation
List (SOL) that came into effect on 1 July 2010, as well as the revocation
of the Migration Occupation in Demand List (MODL) and the Critical Skills
List (CSL). These priority processing arrangements apply to applications
already lodged with the Department of Immigration and Citizenship, as well
as to future applications.

The new priority processing arrangements apply to the following visa
programs:
· The Employer Nomination Scheme (ENS)
· The Regional Sponsored Migration Scheme (RSMS)
· General Skilled Migration (GSM)

The following GSM visa subclasses are exempt from the priority processing
provisions specified in Direction 48:
· Skilled – Recognised Graduate Subclass 476
· Skilled – Graduate Subclass 485
· Skilled – Designated Area – Sponsored (Residence) Subclass 883
· Skilled – Regional Subclass 887

Applications for these visa subclasses will be processed in the order in
which they are received.

The following GSM applications are exempt from Direction 48:
· applications that have been remitted by the Migration Review Tribunal
for reconsideration;
· applications where it is readily apparent that the criteria for grant
of the visa would not be satisfied;
· applications by members of the family unit of a person who holds a
temporary or provisional GSM visa (subsequent entrant applications).
· visa applications for a Skilled – Regional Sponsored Subclass 487
visa where the applicant holds a Skilled – Independent Regional
(Provisional) Subclass 495 visa, Skilled – Designated Area-sponsored
(Provisional) Subclass 496 visa, Skilled – Regional Sponsored Subclass 487
visa or Skilled – Regional Sponsored Subclass 475 visa at the time they
apply.


The Skilled Migration visa processing priorities

Under the Ministerial Direction, the following processing priorities (with
highest priority listed first) apply:

Applications from people who are employer sponsored under the ENS and
the RSMS.
Applications from people who are nominated by a state or territory
government agency with a nominated occupation that is specified on that
state or territory’s state migration plan.
Applications from people who have nominated an occupation on the new
Skilled Occupation List (SOL) – Schedule 3 in effect from 1 July 2010.

Priority Processing Exemptions & Current Processing Times


Visa Subclasses 476, 485 and 887 are exempt from the priority processing
changes. Applications under these subclasses will continue to be
processed in the order in which they were received by the department – the
following subclass by application lodgement date identifies cases
currently being considered:

Visa Subclass

Skilled – Graduate Subclass 485
VC 485 (paper): 21 September 2009
Skilled – Regional Subclass 887
VB 887 (paper): Lodged in July 2010

Skilled Onshore E-Lodged Applications - Priority Group 3
885, 886 and 487 - Applications lodged 14 August 2008


Processing News

INCREASED VISA APPLICATION CHARGES (VACs) – 1JULY 2010

Information on fees and charges is published on the department's website
at Fees & Charges - Applications & Forms - Visas & Immigration

When a VAC is changed, the new amount applies to all visa applications
received by the department on and after the day the VAC is changed.
Therefore if an application will be received by the department on or after
1 July 2010 please ensure that the correct VAC is paid. An application
has not been validly made until the full VAC is received.

We have been advised that the relevant visa charges have increased as
follows:

If the first instalment of the VAC payable was previously $AUD230 it is
$AUD235 from 1 July 2010
If the first instalment of the VAC payable was previously $AUD2525 it is
$AUD2575 from 1 July 2010

For GSM applicants liable to payment of a second instalment of the VAC the
amount payable will be $AUD3575 for applications lodged on or after 1 July
2010. Applicants are not required to pay the second instalment until
requested to do so by the department.


NEW SKILLED OCCUPATION LIST (SOL) – 1 JULY 2010.


On 17 May 2010, the Minister for Immigration and Citizenship, Senator
Chris Evans, announced the list of occupations included in the new Skilled
Occupation List (SOL). The new SOL came into effect on 1 July 2010.
Applications lodged prior to the implementation of the new SOL will not be

INTRODUCTION THE AUSTRALIAN AND NEW ZEALAND STANDARD CLASSIFICATION OF
OCCUPATIONS (ANZSCO) – 1 JULY 2010


ANZSCO is a classification system that provides for the standardised
collection, analysis, and dissemination of occupation data. From 1 July
2010 ANZSCO replaced the Australian Standard Classification of Occupations
(ASCO) currently used by the department. Further information about this

INFORMATION ABOUT PROVIDING DOCUMENTS

Applicants for General Skilled Migration (GSM) are strongly encouraged to
submit supporting documentation electronically. Providing scanned copies
of documents reduces postal and administrative delays in receiving and
processing information.

GSM processing offices accept scanned copies of original documents
(non-certified) provided they are in colour. If you scan documents in
black and white, then they must be scanned copies of certified copies. The
valid file types for attaching documents are BMP, DOC, DOT, GIF, JPG, PDF,
RTF, TXT and XLS.

Information which will assist you in attaching documents to your
application or in emailing them to the department is available on the

E-lodged applications

If you e-lodged this application you are strongly encouraged to attach all
the supporting documentation to the application in the web-browser. This
is the preferred procedure for providing supporting documents for an

MEDICAL RESULTS

If you have undertaken your medical examination at Health Services
Australia (HSA), please do not post your medical results to us unless your
case officer requests you to do so. Please store your results in a secure
place and do not open the sealed envelope.

New Priority Processing Arrangements for GSM Visas
The Department of Immigration and Citizenship (DIAC) has announced new General Skilled Migration (GSM) processing priorities:

Applications from people who are employer sponsored under the Employer Nomination Scheme (ENS) and the Regional Sponsored Migration Scheme (RSMS);
Applications from people who are nominated by a state or territory government agency with a nominated occupation that is specified on that state or territory’s state migration plan:- Applications which have already been nominated by a state or territory government with an occupation that is subsequently specified in their nominating state or territory’s state migration plan will receive Priority 2 processing.
Applications from people who have nominated an occupation on the new Skilled Occupation List (SOL) - Schedule 3 in effect from 1 July 2010:- This includes all applicants with a nominated occupation of Accountant, except those already in Priority 1 or 2; and
All other applications are to be processed in the order in which they are received:- Existing applicants with a nominated occupation of Computing Professional (nec), Hospital Pharmacist and Retail Pharmacist who already have a case officer will be contacted by the case officer about their processing arrangements:- DIAC advises that priority 4 applicants will have “a long wait”.

The following GSM subclasses are subject to priority processing:

175; 176; 475; 487; 495; 496; 497; 861; 862; 863; 880; 881; 882; 885; and 886.



The following are exempt from priority processing and will be processed in the order in which they are received:

Applications for Subclass 476; 485; 883; and 887;
Applications that are remitted to DIAC by the Migration Review Tribunal (MRT);
Applications where it is “readily apparent that the criteria for grant of a visa would not be satisfied"; and
Applications from subsequent entrants.

These priority processing arrangements apply to applications already lodged with DIAC, as well as to future applications. Case officers do not have any discretion to exempt applications from priority processing. See DIAC’s Frequently Asked Questions sheet for further information.

State/Territory Sponsorship for General Skilled Migration (GSM)
The Sponsored Skilled Migration Policy Section, Labour Market Branch, DIAC, has given the MIA the following advice:
In the absence of State Migration Plans (SMPs), State/Territory government agencies should only seek to nominate applicants whose occupation is listed in Schedule 3.

Once their State Migration Plan commences, they will have access to Schedule 4 occupations provided the nominated occupation is included within the relevant Plan or the jurisdiction identifies the occupation as an off-list nomination. In the case of off-list, the occupation can be any occupation listed in Schedule 4 even if it is not listed within the relevant Plan. It is intended that each jurisdiction will have 100 primary off-list nominations to use per program year.

States/Territories should not seek to nominate an applicant from Schedule 4 unless there is a plan in place as within the Migration Regulations 1994, there is a Schedule 2 time of decision requirement for the applicable visa subclasses that 'the Minister accepts the nomination'. For the nomination to be accepted, it will need to be made from Schedule 3 while there is no Plan in place and once there is a Plan, that the nomination be in accordance with the Plan.

The MIA Queensland Branch President Sharon Harris has been advised that SMPs will not be released by anyone now until after the Federal Election.

One of the problems that people had last year was that some email addresses don't always receive the Update from DIAC due to ISP filters, spam filters etc, so posting it on here is actually very useful for some.

Lets try and keep it as an update thread though, if people want to discuss and dissect the contents of the weekly email could they please do it elsewhere.
