Default I'm Aussie by Descent - want to make my baby a Citizen

Hi,

I'm planning on going over to Aus to visit my mum later this year. I might stay while my partner sorts out his visa. Does anyone know how I go about making my baby a citizen? I'm Aussie by descent rather than born there so I'm guessing I can't just apply for a passport for him...?

Thanks, Nikki

You will need to have spent at least two cumulative years in Australia in order for your son to be eligible to be registered as an Australian citizen by descent if he was also born outside Australia.

Thanks for the reply.

Do you know how this works with a travel visa for him? If this expires after 90 days can he just stay with me or will he need to leave?

Until he’s a citizen he’ll need an appropriate visa to travel to and remain in Australia.

Do you know how long you’ve spent in Australia in total?

I lived there for a year - not long enough.

My partner is applying for a spouse visa. I believe we can put the baby on with him. I'm looking for a way to have a few more months with my mum before the visa comes through.

Any time - including visits - is included. It would be a good idea to request your movement records from the DoHA to check exactly how much time you have spent in Oz.
