i have applied in last feb,2002 under skilled independent
category.under asco code-2211.11.By profession , i am chartered
accountant.i have received file no in 12th feb,2002 accpeting my PR
application.

My IELTS score is overall 6 band-7.0 in writing,6.0 in speaking,6.5 in
listening and 4.5 in reading.

From first year of graduation,i was studied in english medium.after
that in my chartered accountancy also i thoroughly studied in english
medium.

I have satisfied all the requirements of DIMIA-degree assessment,
degree verification,IELTS Test score.

till date i have not received the Pre-grant letter.

I have following questions:
1.one i have got the file no letter,do i mean that i have satisfied
all the basic requirements?if yes,that means i dont have to appear for
IELTS again as my score in reading is 4.5 band! pls advice.
2.some of the people in this groups have advised that my application
was rejected by DIMIA due to 4.5 score in reading.my argument is that
even i have studied in english medium from first year of graduation
and also in chartered accountacy course.also i have send the english
medium certificates to DIMIA alongwith my IELTS test score,after
accepting my PR application,do they refused my file on the gorund that
i have secured 4.5 band in reading ?

pls advice me.hope for better advice.

Dear Ashwin,

Having a score of less than 5 in any part of the IELTS test is insufficient
for almost all Australian skilled migration visa categories Australia, and
is never enough for a skilled independent visa. I suggest you read Booklet
No. 6 on skilled migration again. If you don't do the test again your
application will be refused. You cannot expect a waiver of the IELTS
requirement if Indian educated unless you attended one of the major
universities.

Ashwin,

what naive assurance/ opinion do you want to hear? There are strict ASPC rules written and available for all - Skilled Booklet and so on.

You could retake IELTS more than 4 times since Feb 2002, and then send SK47 when (if) you were over 6pts in all 4 parts.

What do you mean by accepting? They've just acknowledged that they've received your application. It's on a big pile now, and you'll just have to wait, although I must admit after 16 months you'd expect to hear something. Have you been requested medicals and police checks yet?

No you haven't! As you should know, you need a band 5 or higher for ALL sections of the IELTS test.
You can provide all kinds of evidence showing your education has been in English and stating you have at least functional English because of that, but your IELTS results contradict this, and that can be enough grounds for DIMIA to refuse your application. Maybe if you hadn't sent your IELTS but just those other documents, they wouldn't question your English skills, but it's too late for that now.

Have you gotten medical and police check requests yet? Those will have to come first, before you'll get a (pre)grant letter.

No, it's just an acknowledgement that your application has been received. It does not mean you have satisfied the requirements.

As said before, and by others in other theads, yes, it is possible, and likely, that your application has been or will be refused on the grounds of a band score that is too low.

Well, you can wait until somebody advices you that everything is going to be OK, but you'd be fooling yourself!
My advice: Get in contact with ASPC and ask whether your application is still just on the pile waiting, or whether it has been refused and ASPC has failed to notify you of the refusal. If it is still on the pile, don't be ignorant and hope it will all work out, because you are likely heading straight for refusal. Go and do that IELTS test again and have the results sent to ASPC as soon as possible.
