Default fathers rights on imagration

I'm looking for information about immigration.
I live in Scotland but my fience lives in Perth (Australia)
I'm looking to move over in July but my 9 year old sons dad has started making it tricky. My son was born before the law changed in 2006 but his dad was registered as his dad in 2009 ( he paid to have this done)
Do I still need his permission on the visa? Or does it have to be settled through a court?
Also , I know the courts need proof of schooling, finances , home , family support , how i intend to keep contact between father and son and my relation with my fience but is there anything else I can expect to be asked for ?
