Ex-partners and the kids!
Hi I have read some stuff on this before but I just wanted to know, my defacto has kids in the UK that he pays for but we are not taking them with us. The ex-wife is a bit resident to the fact her kids have to have a medical. Can we get a stat dec from our solicitors saying that even if the mother dies these children will be looked after in the UK by their Grandparents? They don't want to come with us and have no desire to be there, they have a full life over here.
The eldest one is 16 and the youngest is 11. The oldest is at college and the youngest has just started secondary school.
If yo could give any advice this would be great
cheers

Such a statutory declaration would likely have little impact as circumstances would have changed in a situation where the mother had died.
Even if the children do medicals they can't get a visa unless the mother consents, if she has custody. Either now or later on (certainly not before age 16). Is she aware of this?
Every case like this is different and you really need professional advice. Online forums can't help much with such complexities.

we are having trouble with hubby's ex and children's meds just wondered how you overcame the situation any advice would be good. we have already sent co stat dec saying that he would not be responsible for them if she died as her mother would have the children (16 + 13) but that is not enough.
many thanks

If you have custody or access rights to the children, then DIMA normally expect you to take them for a medical.
If you have no custody or access rights, then send the proof to your case officer. Normally this should be accepted, if you can provide proof the other partner is refusing permission for the children to have medical (if you have no access rights) then it's even more compelling evidence.
