I intend to apply my visa under this catergory Australian
Sponsored (subclass 138) visa.
I have a sister who is staying in Sydney and my question is as follow.
For migration purpose I have been assessed as a Business machine
mechanic.
The problem is my sister is residing in one of the listed postcodes
1000-1920; 2000-2249; 2555-2574; 2740-2786 and I am required to
nominate an occupation that is on the Sydney and Selected Areas
Skilled Shortage List.

If my sister decides to move to another state or post codes which isnot
indicated in the above list, can she still sponsor my application.

Would like to know if there is any criteria on the length of stay in a
specific post codes in order for her to sponsor my application

hi, i think the sponsor must live in the area at least one year before
sponsoring. Look it up at the DIMIA website to be sure.

You can also try for state nomination which needs 70 points only, try
to look for a job nomination that is closely related to your work from
their skill shortage list. This is what my hubby did. He had his skills
assessed by our useless agent thru Vetasses which just placed him in
the skill-matching database for two years without any feedback. Too bad
we wasted time and money with the agent. We decided to do it by
ourselves by gaining info thru the net. I found a job nomination that
is closely related to his work and applied to TRA and got approved.
Initially we also planned for 138 visa coz he has a sister in Sydney,
then i stumbled upon the 137 vista (STNI). We opted for STNI coz the
passing points is only 70 and Assurance of Support is not mandatory.But
you are required to live in that particular state for two years,
though. After that you can move anywhere you want.

This is a really grey area. There's no minimum residence period as far as I know, but DIMIA will most likely look for some evidence that she is *living* in the new area, not just visiting.

You need to get some good professional advice to look at this in more detail.

Alternatively:

- look at the STNI or Skill Matching visas, sponsored by Vic, SA, Tas or WA (as someone else has noted)
- if you can find an employer to hire you and sponsor, you can go for PR through ENS or RSMS
- as an absolute last resort (because your rights are very restricted), look at the SIR visa with sponsorship from a state like South Australia.
