Did it happen before or after visa grant? When you submitted all of your paperwork for the visa, had this conviction already happened, or was it afterwards?

Yes. Any change in your circumstances must be declared to DIAC, including criminal convictions (and I believe DUI is a criminal conviction, is it not?).

I'll repeat the other posters questions and ask if the DUI happened before or after your visa grant.
Has your visa been validated already? Did it happen before or after validation? I did a quick search through your profile and it seems like it might have been validated back in May.
If it was before your visa was granted then it most definitely has to be declared. If it was after grand and before the validation then it would also need to be declared.
Where I get confused though is what happens if you've already been granted your PR and validated it and then get the DUI? Not sure in that scenario....

DUI = Criminal conviction... might not affect your current PR status but will affect when you do decide to apply for citizenship.

This Involves My Daft 20year old son. Caught morning after night before 5mcgs / per 100mls over the limit. Judge sympathetic , but mandatory ban, minimum fine and no points!!!!!! very recent. Visa granted to all family members last May. He is planning on travelling before us, just doesn't want to buy ticket until sure of position. Thanks for your comments. Will p contact DIAC to be Completely sure.

If they were only granted this May (2009) then they either haven't validated... in which case they need to declare it and the main applicant may/may not need to enter first, or... they have validated and it shouldn't matter what order.

If the visas were granted last May (2008) then they would have been validated already. They should be free to enter in whatever order they want. I thought the main applicant clause was just for validation not for any later trips.
If they were only granted this May (2009) then they either haven't validated... in which case they need to declare it and the main applicant may/may not need to enter first, or... they have validated and it shouldn't matter what order.

I initially had a look as you couldn't really answer the question without knowing. It appears as thought the visa was granted Feb 2008.

So presumably the visas would have had to have been validated by now.

Thank you for your comments. Our Visas have all been validated. we now have all the usual obstacles..Work Pensions House to sell, Oh and of course this Headache, before we can all settle down to a life in Oz!!
