Hi Everyone,
Just a quick question that you good people might be able to help my Brother-in-Law with!
He is the process of gathering together the final bits and pieces to apply for his Spouse Visa.
He has two children from a previous relationship, neither are going to be emigrating on the Visa.
One of the kids is well over 18, lives in his own house and as such is definitely not classed as dependent.
The other child is 17 (18 in May). She lives with her mother, has a job and no longer receives any financial support from her father.
The question then is, is she deemed by DIMIA (or whatever they're called now! ) as still being dependent simply by the fact she is under 18?
I seem to remember reading somewhere that as a general rule all children under the age of 18 are automatically classed as dependent.
I've checked the info on form 47SP but it seems a bit vague

If it turns out she is classed as dependent then he'll have to organise a trip down to Manchester for a medical and send for a police check!

That's correct. The only exception is if child is married (and usually also if engaged or in a de-facto relationship).
