Daughter changed her mind, now wants to come to Aus!

Default Daughter changed her mind, now wants to come to Aus!

Hi All,
I am in Perth on a 457 visa and came out 10 month ago with husband and one daughter. On our initial application my employer was happy to sponsor our other daugher as well. In the end she chose to stay at home and wouldnt go for her chest xray.

Does anyone know if this original application can be resurrected now?

I have just been promoted to a permanent post and with it will come employer sponsorship for PR.
The one who stayed behind is 18 years and now needs the support of her parents, penniless, jobless and miserable without us.

Can anyone suggest a solution to this dilema?

If she is your only remaining child (and your partners, so include any step, adopted children etc) she will qualify as 'Last Remaining Relative' assuming she is unmarried.

If you (or partner/spouse) have any other children she will not qualify.

Other options include; working holiday visa or student visa

The key question is whether or not she is still "dependent" on you.

If so, she could probably be included in an offshore ENS application (or onshore, if she came to Australia as a dependent on a 457). Or you could declare her as dependent on your ENS, she would do medicals and police checks, and then you could immediately sponsor for a Child visa.

Working out whether she is "dependent" is not a DIY area. Get some good professional assistance. George Lombard in Sydney should be able to help, or maybe Steven O'Neil in Perth. Be prepared to pay for such assistance.

Hi JAJ,
Its a little complicated but here goes. Had a positive skills assessment from ANMC (did'nt require it as I was over 45 years and couldnt apply for a 175 visa- so registered with NMBWA and secured a post with a hospital and gained a 4 year 457 visa. I applied for a job within WA Health (same employer) that was advertised widely and was the only one to be deemed suitable for interview (the job is specialised and I have 6 years experience and an MSc to support this). I was in a position to bargain and indicated that for me to take the post, a term and condition was to have employer sponsorship for PR. They didnt see that as a problem.

Daughter back in UK in now dependant on us financially and emotionally (she has woken up to the reallity of going it alone and now regrets her decision not to be included in the 457 visa. We have bailed her out financially and booked her a ticket to come over for a short holiday to give us some breathing space - I know that she will have to go back but maybe as a parent I can send her back with support to avoid the mess that she's in.
I agree, I think that we need to take professional advice on this one and will make contact with Steven O'Neil in Perth, only because its easier to have a face to face and will have our wayward daughter with us.
