hi my name is michelle,i have been here 2 years now, my mum is cranni.Im 20 years old.
I have a friend here on a holiday, he would like to stay, but he has a criminal conviction over 5 years ago, he was 19 and under.
they are.
section 2 affray
He is a qualified joiner, do you think he would be able to get a 457 temp visa
thanks for any help.

The first question is what was the sentence? If it was lessthan 1 year he should stand a good chance, he may need to provide charecter refs etc. Consulting with an agent is probably a good idea.

There is a section on the DIAC that gives some information on "good charecter" requirements

thanks guys for your replies.any more info would be greatly appreciated. there was no proson sentence just a fine.

he went to the isle of man, with his friend. they where set upon be a group of lads, they had to defend themselves but ended up getting the better of the other lads, the police came just as they where getting stuck in and they looked as if they where the guilty parties. his mate went to prison. they where banned from the island for 5 years.

I would suggest speaking to a good agent - several post on the forum - and get advice as to the best way to go about it. A case like that needs to have a careful description of the event written, so as to show your friend in as good a light as possible. Its also very likely that he would have to provide character references. O'm not saying it isn't do-able, but I really think he needs an agent on board to work with him.

Hi Michelle

Surely your friend was required to declare his previous conviction on his application for the visa he used to enter on now?

Anyone correct me if i am wrong but I believe this is a requirement for any visa application, including an evisa or tourist or working holiday visa.

If he did declare it then ok - this will go in his favour in future because immigration will be aware already. If he didnt declare it then immigration may question why not as they will certainly want to know about any visa held or previous visits to OZ during any further visa applications, temp or perm!

I am unsure if this offence over 5 years ago will affect any future visa application, which he must declare as a police certificate is required anyway. Polyanna is the person to listen too on this score.

I think issues will more likely be raised by immigration if his conviction wasnt declared for him to enter this time. If he made false declerations to get in now, can they trust him to be truthful for a more substansive visa? Just something to bare in mind. Hope all that makes sense Michelle. Trying to help.

On a positive note -Joiner is on the wanted list for OZ and i should imagine if he can get an offer of employment or a sponsor then he is half way there for satisfying the requirements.
