Default Conversion of Temp Spouse Visa to PR

I am currently on a Temp Spouse Visa here in Oz, in a couple of weeks I'll be allowed to apply for PR.

However, I'm off home on July 16th (for "good").

EDIT:

If I were to come to Oz in the future (5yrs+) to work/live, does anyone know whether I would have to start at the beginning of the process again?

The issue is as you are still on a temp spouse visa you have to by law inform the department of any changes so if you leave Australia you have to let them know.

Its a matter of factors did you apply for your spouse visa offshore or onshore? Are you leaving Australia with your partner to live in the UK?

this might help you get a better answer with regards to your PR.

Thanks for your reply.

I applied for, & received, my temp spouse visa in the UK. Yes, I am leaving Australia with my wife to live in the UK.

As you applyed offshore and as you will be living with your Australian wife you should be granted your PR.

If you dont return to Austalia with in five years and your still with your Australian wife, apply for a Resendent return visa on the grounds you have close ties to Australia on the grounds you left Australia with your wife and your both now returning to live in Australia.

Hi Mac,

PR is right, since you applied offshore initially, the subclass 100 visa can also be granted while you're offshore, so you'll have a good long period to make up your mind about whether you settle here. Not so sure about the advice concerning a resident return visa, you'd need to look at the requirements closer to the date.

sorry to hijack your thread, but along the same lines...any idea how long it is currently taking for this stage of the visa to be processed? i am on shore and applied February 12. Heard nothing so far. My two years was up late january...
