Claiming Migration Costs Back from the TAX Office
Hi All
I'm currently on a 457 visa (just renewed for another 4 years) based in Sydney
Australia. I currently going through getting my PR visa.
I've been told by a few people I could claim my costs back from my Tax submission.
They tell me I can claim it back because it's a expense related to my employment.
They say with out the visa I couldn't work and therefore can off-set the cost
against my tax.
Has anybody heard of this or knows if this is true? I could ask the Tax Office or
wait until I submit my 2002 tax return.

Hi Kieron,
If you are the holder of an employer nominated 457 your employer can certainly claim
the expense of sponsoring you, however afaik costs involved in obtaining your own
visa, even if employment related, are not tax deductible. The answer in a case like
this is to get a tax accountant to sort it out for you. As a 457 holder you should be
asking about your living away from home allowance when you talk to the accountant.

George, on 457 employer-sponsered, but when we asked an accountant about the LAFHA we were told it's organised by the employer! Our UK employer knows nothing about this allowance, nor Oz tax, so we havent taken it further (can we do it ourselves?).

The LAFHA is indeed arranged/made available by the employer as a result of discussions over the salary package.
In other words it doesn't take the form of an allowable deduction that you claim when computing the assessable income on your Aussie Tax Return.
So you need to establish with your Australian employer that he/she is willing to package your salary so that part represents LAFHA.
I would also agree with George in that I doubt the costs relating to obtaining the 457-visa are deductible - have a search on the ATO site for more info:

Thanks for the infor. I have claimed my 457 visa costs back via my last tax return.
Regarding LAFHA, the company I now work for do not do this. Because I travel a lot
and they pay LAFHA as a per diam when I'm away from Sydney.
I will ask my accountant when I submit my next tax return.
