Hi,

Could anyone in the know be able to help with this one please?

I am in Australia on a 457 working for one employer and wish to change employment to another. The other day I finally got an offer I can't refuse from another employer, who is willing to help with my visa but they are not quite sure what needs to be done next. I was told on my interwiev that they have sponsored people from the UK before and that should not be a problem, but then I had a phonecall from them yesterday after I agreed to their offer, asking me what needs to be done next.

In the meantime, I have applied for a full PR via the relative sponsored 176 last month and had the medicals done already and UK police checks submitted, but no CO yet.

I am definitely accepting the new offer subject to their sucessful procurement of my (new 457?) visa and my question is what needs to be done now; does the new employer now apply for the fresh 457 for me and I give notice to my current employer when this is granted or, as I have already appiled for "another substantive visa", I myself apply for a bridging visa with no work restrictions?

I got dragged here on a 457 from the UK under the false promises and am not very happy with the current employer but do not want to find myself in the situation where I resign from my current job but the other visa is not granted yet and I end up in breach of immigration rules, especially in the view that I have decided to settle here for good.

Any help on the logistics of the matter would be very much appreciated.

Would you not be best to wait for yer PR and then go to the other company

I don't think 457 visa holders are eligible for some kind of Bridging visa or such kind of thing....Did you discussed with your new employer of ENS option rather than 457? Any ways your 176 will be late if it is relative sponsored...ENS will be a faster... If you opt for going ahead with new 457 then you should be very careful in regard when to let your existing employer know (before applying new 457 or after it is granted) .I suggest take confidence of your existing employer too before applying.....

I used to deal with highly specialised medical imaging stuff in the UK, my current employer treats me now as a glorified installer with an IQ of below 30.
By the time my PR comes through my experience with the kit would be yesterdays technology and in the meantime I may just go mental as I am asked to repair a sophisticated piece of kit with a file and a hammer.

Besides I don't really care about how long my PR takes as I am already here but staying put with these ****heads is not an option.

Thanks Mayur,

My current employer is not interested in entertaining my requests for ENS or LAFHA despite their promises to the contrary before they got me here.
I am definitely going to leave them no matter what, I was hoping that someone like George or Allan may know the logistics of keeping me legal here whilst inbetween jobs.

Anyone please?

I hear you,im a specialised kids uk trained itu nurse with many years experience but here in Brisbane they are so far behind the uk,i too feel im becoming deskilled.It is so frustrating when you try to argue a point about some of the care given and they just answer "well thats what the consultant (god)so we just do it" WELL GET SOME BLOODY BALL'S AND MOVE WITH THE ****ING TIMES Ok rant over and feeling better

I am kinda going thro the similar situation, to the extent tht a new prospective employer is ready to sponsor my 457..what i understand on this so far is that you should apply for a new 457, rtaher than transferring the existing one...in case of former, you need not tell ur current employer about it, and if and when ur new 457 is granted, ur current one becomes automatically invalid...in the case of latter, you need to inform ur current employer and they need to agree to transfer...this is a risky proposition, as ur current employer then may want to terminate ur employment, thinking tht u r leaving anyways...in tht case, for the interim period u may have to leave the country..

So best option is to ask new employer to apply for a new 457, and dont bother to inform ur current employer right now, until and unless u have some bit of confirmation (like a pre-grant letter) on ur new 457...

If the new opportunity is really good, I wudn't wait for my PR to switch the job...I think it is a risk worth taking, given u can manage it cautiously, with keeping continuous touch with ur new employer and ensuring they are taking right steps..

And how about convincing your New employer for ENS? I was in similar situation...when i was switching my company (i'm also on 457). But My new company HR team was very much aware of the possibilities and options they had with them and suggested me well before i joined them...So just try to suggest and try to convince your new employer about ENS option...i suggest try to talk with HR team directly of your new company.....

Thanks guys,

The way I understand this, the grant of the new 457 will automatically cancel the old one. Even though I have no loyalty to my present employer after their lies and lousy treatment, I am still a professional so I would like to give them the option of a 4 week notice, It looks like that is not going to be the case if I get a new 457 as I will then be in breach of the immigration rules if I stay working for the first lot even for the 4 weeks.

I have no idea how they are likely to react to my leaving, they are so up themselves and treat me like a slave so I would not put it past them to escort me from the building with security immediately after I tel them am leaving.

Thanks for your help, I'll keep u posted how it goes.
