Default Australian DIAC Migration Law Changes – in force from 1 January 2010

There are some very important changes that will come into force on 1 January 2010 with respect to Australian skilled visa applicants.

I have posted a summary on our blog:
http://sortoutmyvisa.com/blog

Please keep a look out there for further updates (though ther agents or I will undoubtedly post more information here as soon as more is at hand.)

Apologies if this has already been noted, I have not spotted the thread.

Cheers,
Veronika

Veronika is a registered migration agent. They are not known for publishing unsubstantiated rumours - its not good for business

Dear Veronika,
Is this update with respect to already lodged applicaiton or the people who want lodge their application in 2010 ? How bad it will effect GSM 175 (Both on CSL and MODL) ?
Thanks and awaiting your comments

I think the first line of the article answered that question.

This is a summary of some very important changes that will effect all future offshore visa applicants and some lodged onshore visa applicants from 1 January 2010:

Umm well the first line was quite clear and I quoted it too i.e. "all future applications....".

Don't really know what part of that is ambiguous?

Default Change of immigration rules 2010..

So the rules are going to be changed in 2010. I have applied for engineering Australia under CDR in November 2009 what will happen to my case. If i get positive CDR from engineering Australia then for second stage of apply will i be considered in new rule or in old rule.

Hi Sherry,

Your question makes no sense. There are some minor adjustments taking place to the general skilled migration program which at this stage are planned to affect onshore graduates only. Unfortunately some of those affected - and some migration agents facing a loss of market share - have chosen to portray these changes as of wide-reaching if not cataclysmic impact. For example, on the basis of your brief description, I don't see how you're affected at all.

Cheers,

George Lombard

I just want to clarify that my comment to Sherry was not intended to reflect on Veronika's blog link - which very properly makes the point that no occupations have been identified yet as coming within this provision and also indicates the significance of these changes with respect to the management of the onshore student caseload. I didn't know of Veronika's post when I made my post and of course now that the threads have been merged I can't edit my post.

Cheers,

George Lombard

According to Explanatory Statement to Migration Amendment Regulations 2009 (No. 15), onshore trades will be required to get a new skilled assessment after 1 Jan 2010.

The purpose of the Regulations is to amend the Principal Regulations to:

· to ensure that the issuing of a refund of the second instalment of the visa application charge (VAC) is limited to visa classes that only require payment of the second visa application charge if the applicant does not have functional English at time of decision;

· provide that an applicant for an onshore General Skilled Migration visa (GSM visa) subclass must have a suitable skills assessment to satisfy the Schedule 1 requirement for the prescribed visa subclasses (Schedule 849 to the Principal Regulations refers); and

· provide that an applicant for an onshore GSM visa who nominates an occupation which is a identified “trade occupation” specified by the Minister for Immigration and Citizenship in an instrument in writing, would be required to obtain a new skills assessment after 1 January 2010 (Schedule 845 to the Regulations refers).
