Hi,

Hope you can help. Our good friend (UK by birth but now Aussie Citizen) went on holiday to the UK and married (yes, it was a surprise to all of us!!) whilst there. He's now back in Aus and trying to decide how to bring his wife over (she's a UK citizen with no dependents).

Trying to decide if its better for her to come here on say a holiday visa and apply from here, or to apply whilst she is still in the UK? She has to sell her house etc (its been a whirlwind for them) and hopes to come to Australia in November.

Advice greatly appreciated.

Partner (Provisional) visa (subclass 309) and Partner (Migrant) visa (subclass 100) is the visa if applying from the UK, Partner visa (subclasses 820 and 801)
Partner visa (subclasses 820 and 801) is the onshore version, if she arrives on a tourist visa first. However that takes longer and is more expensive, plus DIBP may not allow entry if they think she is coming here to live while only holding a tourist visa.

If she applies for the offshore visa (the 309/100) she could then come here on holiday whilst awaiting the grant of the visa, then make a quick trip to NZ (or even back to the UK) when DIBP are ready to grant it.

Get them to look at the links, and read the partner booklet throughly
