Default Applying under subclass 176, bringing de facto partner

Does anyone have any experience in this? I will be applying via subclass 176 and would like to bring my American de facto partner along.

We have been together for more than 3.5 years, and lived together for 17 months on and off because US Immigration does not allow me to stay more than 90 days each time. At the time I lodge, we would have been apart for 9 months within the last 12 years. We chat on the phone everyday for hours, and I think I have sufficient records to prove our de facto status. The reason I could not go there for 90 days this year is because of my business commitments here. Is the DIAC flexible with the 12 months living together requirement? Also, will I have to prove that I have funds for him for 2 years, or does my sponsor have to prove it?

Any advice would be appreciated!
