Question Applying for permenant res on 457 visa over 45

Hi
I am currently looking to come to Aus on a 457 visa. I am hoping to convert this to permenant residency however I will be 45 on the 25th April 2011.
I was wondering if I would still be eligible to apply in the future or whether I should start applying now before I get to Aus

The 457 visa is a temporary visa and always will be, it is not possible to "convert" one visa into another and there is no automatic pathway to PR from the 457. Although it is a common misconception.

So if you want to look into PR options you have to look at PR visas and whether you qualify for them. It is very difficult to comment further as we know nothing about you, in particular the critical matter of what do you do for a living? And do you have the 457 sponsor lined up? Tell us a bit more and we will try to help.

I am a speech and language therapist-going to be working for government as part of Positive Futures initiative

If, after arriving on 457, you apply for a 856 (ENS Onshore), they may waive age limitation as per follows:
Age exemptions

Exceptional circumstances for the age requirement might be considered in the following cases:

If the applicant is:

* 45 to less than 50 years old; or
* 50 to less than 55 years old, and if the nominated occupation has minimum skill requirement of a diploma or higher qualification; or
* 55 to less than 60 years old, and if the nominated occupation has a minimum skill requirement of a degree or higher qualification.

The delegate must also be satisfied that the:

* position is essential to the operation of the business
* position requires a person with skills and experience acquired over many years and
* employer demonstrates that the position is so unusual or highly specialised that it was not possible to find, in Australia and overseas, a suitably qualified person who was younger than the applicant.

Note: Exceptional circumstances are generally not considered for applicants who are 60 years or older.

Have you checked to see if the occupation is on the SOL/ ENSOL? If it is then it might be possible to get a PR visa straight away, you would need to do a skills assessment first though.

If you go on a 457 then you would need to ask them to sponsor you for a PR visa in the future and they have no obligation to do so. You would be at their mercy and you don't know what will happen, you might not get along with your boss and so they decide not to support the application for example.

After July 1st, the age limit for skilled migrant visas increases so you might be able to apply by yourself in the future if you pass the points test (which will be hard for someone over 45).
