Question Applying for 138 - sponsorship

Sorry, another question but I'm very confused!

My partners brother is an Australian citizen and willing to sponsor us. I can meet basic requirements - but my partner can't (over 45 yrs old).

Is it possible for his brother to sponsor me or us? (would I be the primary applicant or him?).

But if his brother sponsors just me - I don't think I can then sponsor my partner!

We are not married but in a defacto relationship.

Absolutely any help would be much appreciated!! Thank you.

We are in a similar situation and it can be done. For the skills assessment your skills need to be assessed only. For the visa application your partner will be the primary applicant with his brother as sponsor (your skills assessment will be on the visa app to provide the points). I am 46 and the primary visa applicant (my Uncle sponsoring) but my hubby's skills provide the points (he's 35). Have I made this clear?

Will it matter that we are not married, if we can provide evidence of a defacto relationship?

So he applies as the applicant, I get the 110 points, and his brother sponsors 'us'.

Does this mean we both get PR visas?

No - de facto relationship is as good as married.

Yes - your partner is the applicant, you get the points for skills and his brother sponsors you both.

Yes - you both get PR.
