According to Mr. Humphries post, if you have a positive selection decision the lawsuit will not affect you:-

thanks a lot for the reply. you said it won't affect my application if i received a positive selection decision...after the interview and medical exam, they said within 3-6 months they're gonna notify me if:

1. they need other documents , or
2. they need my passport for visa issuance...

does that mean i got a positive selection decision already? right now i'm waiting for that passport request from the embassy. also, do i have reply to the notice they sent, either to object or to opt-out? i would really appreciate it if you experts shed light on these matters. thanks a lot and more power!

Hi atm,

I am far from an expert, I just try to help where I can.

This is my understanding of your situation:

You have received a positive selection decision - if you had been rejected you wouldn't have been asked to do medicals - therefore you are not part of the class affected by the class action.

As you are not part of the class, you do not need to opt-out, so you can ignore the notice.

All you need to do is sit back and wait for instructions, hopefully you will get your passport request soon!
