Dear Madame/sir


I have been in Canada for almost two years on visitor visa. We have
submitted application for Canadian permanent residents, and have
received the initial assessment with interview waiver. Now I need a
US F1 visa to pursue a graduate study in US. And I will apply it in US
embassy in Canada. My questions are:

1) Since I have to prove my TIE with my home country, is it convincing
to the embassy since I have applied for Canadian permanent resident,
which is an obvious proof of immigration tendency
2) Does it make sense that I just need prove my TIE to Canada since we
have received the initial assessment?
3) What is your suggestion to me in this case, i.e., showing ties to
what country, my home country, or Canada, the country to which I have
submitted the immigration application?

Is there anyone having been in the same boat with me?

Any insights and perspectives will be greatly appreciated. Thanks in

It is a Canadian immigration newsgroup and you are asking question related
to US immigration.

hen it comes to proving ties to home country both US and Canada (as well as
many other countries) have very similar approach. In your case you must
prove substantial ties to your home country, not to Canada. You are only a
visitor here (quite extended visit) and you demonstrated that you have no
intention to return you your home country - thus you'll have extreme
difficulties proving otherwise. You have proven that you want to emigrate
out of your home country.

Fact that you got initial assessment for your Canadian PR application won't
help you.

What ties to Canada are you even talking about? Your PR status here - you
don't have one. Your permanent job here - you don't have one either. If you
are on work permit in Canada then your job is temporary, not permanent. You
don't have any ties to Canada, you cannot even return here if PR visa is not
granted.

The only country you can return to is your home country and you need to
prove having substantial ties there, which you obviously don't have - thus
you may be out of luck.

Give it a shot. Just make sure that you give some good reason for why
you stayed in Canada for the past two years. And give financial
statement from the home country(propery and bank statements). My guess
is you will get the F1 visa as you are not threatening to be a
potential immigrant to U.S(provided you have the I-20 and other stuffs
ready). The fact that you were in Canada will not be used as sole
reason for denying your application. Just because you were in Canada
for the past two years does not mean that you dont have any ties to
your native country. It's entirely upto you to prove your ties to your
country. Remember you are still a citizen of China.The application for
PR in Canada is in no way going(as far as I know)to affect a visa
applied for U.S.

Dont worry too much and apply for the visa and if other credentials
are good you will be treated as like any other applicants I believe.
You have to check though which embassy you have to use. My point is
your stay or application for PR will not affect your F1 visa as far
my knowledge can expand and search.

For US non-immigration visa, you need to prove you won't be staying in
US after your non-immigration visa expires, US doesn't care where you
go, but must be out of US. your initial approval of your Canadian PR
shows you have place to go after you finish staying in US. That's why
I believe you are just fine.
