Default Urgent Help Please: Spousal Sponsorship

Hello,

I am in need of some answers to my question. I find that the Canada
immigration officers I have spoken to on the phone have all seem to be very
unfriendly, very inept, and very unhelpful in every way possible. It seems
like each and everyone that I have spoken either hates their job so much
that it literally shows it in their phone conversation, or that they don't
know what the heck they are talking about.

Anyways, here is my situation. I am a canadian citizen, and my soon to be
wife (who is japanese and over 22 yrs. old) will be applying under the
family class spousal sponsorship. My question is that I am currently back
in school and working part time, thus is there a "stated" minimum amount
needed for gross wages that one needs to make in order to qualify for
spousal sponsorship? If there is, what is the minimum amount required that
one makes in order to sponsor a spouse to Canada? If I do not make the
minimum amount, can my mother act as a co-signer/co-sponsor, or even in the
case as a main sponsor for a daughter in-law?

Also, in regards to criminal records check, my spouse was on a student &
worik visa few years back in Canada and she was told that she needs to also
get a criminal/background check here in Canada as well as in Japan. Is that
the case in her situation? Does criminal/background check, both in Canada
and in Japan, have to be done prior to submitting the application or is it
done during the processing of the application when advised by the Canadian
embassy? As she is currently residing in Japan, and will be visiting
Canada to get our marraige certificate processed... and she will probably be
getting her criminal record check (before submitting our application
package) done here in Canada. As I understand, the results of the criminal
record check done in Canada/and Japan will be sent by the police department
to the applicable Canada Immigration/Embassy offices. Since these background
checks are done prior to submitting our application package, how can we tie
in the criminal record forms that will be sent by the police department, to
our application package which has not been sent yet?

Also, in regards to medical examination, would she have to perform the
medical examination prior to submitting our application package, or would
Immigration Canada inform her to do so?

As she will be here in Canada to get married with me , is there any
stipulation according to immigration Canada that she has to remain in Canada
during the application processing?

Finally, in regards to "photocopied" forms (ie. photocopies of passport, pay
stubs, etc) that will be included with application package, do all forms
have to be notorized?

Hopefully, someone with experience will be able to answer some of my
questions.

Sorry, some other questions I forgot to ask.

As mentioned below, my fiance will be entering Canada from Japan on a
visitors visa and will be married here in Canada. She has also come here to
do her criminal record check as she was previously here more then 6 months
stay a few years back and was told it was necessary here as well as in
Japan. My question is does she need to tell the immigration/customs officer
at the airport when she enters the country the exact nature of her trip (to
get married mainly) as she is also here for pleasure? Will a special
stamp/permit be issued to her if she told the immigration officer that she
is here to be married?

As she will only be staying here for a short period of time as she is still
working in Japan, does the application process for spousal sponsorship
differ in anyways (ie. additional forms to be filled or will she be filed
under a different category of the application?) since we were married here,
and not in Japan? Is there any real advantage if we were to be married
either in Canada or Japan?

She will be returning to Japan to complete the rest of the immigration
package (ie. criminal record check/medical check/etc) Just for confirmation
on application package sending, does the sponor package and the immigrant
applicant package have to be sent together or independent of each other?
She was told that the Canadian embassy in Japan no longer handles
immigration issues, is that true? If so, and if she has to send her own
package where would she then be sending her application package to?

Sorry again, one short question in regards to my application. As my spouse
will be here in Canada to be married, is she allowed to do her medical
examination in Canada rather then in Japan? How long does the medical test
normally take?

Does anyone know approximately what the cost would be (in B.C.) for such a
medical examination for a visitor?

All your questions are clearly answered in the application kit - seems that
you didn't read it yet.

You don't need to meet minimum income requirement when sponsoring a spouse.

Police certificates must be included with the application. When sending
fingerprints to RCMP your wife should indicate that she is applying for PR
visa - CIC will match her file with the clearance.

Medicals must be taken in advance and proof submitted with application.

If you will be applying within Canada then it is strongly advised that she
remains in Canada, but if you would be sponsoring her from abroad then it is
irrelevant.

All copies of supporting documents must be certified as 'true copies'.

She should always tell the truth when entering Canada. If you want to follow
the inland sponsorship process then it is imperative that she gets admitted
to Canada without any fraud, misrepresentation or omission.

If you will file a sponsorship case for spouse abroad then you must follow
the application kit for spouse abroad, instead of the one for spouse in
Canada. Where you are getting married is irrelevant.

Both packages (your sponsorship application and your wife's PR application)
must be submitted together - the address to submit is different for spouse
abroad and for spouse in Canada cases, so follow to the letter instructions
for the process you'll be filing.

Again - read everything from the application package carefully before doing
anything.

Thank you Mr. Miller for your promopt reply.

When you said that I don't need to meet the minimum income requirement when
sponsoring a spouse, I suppose it would help alot if I did meet the minimum
requirements or does it not matter in either case to Canada immigration?
are the minimum requirements accurate as stated on this page:

How much emphasis is placed in terms of the sponsor's financial background
(from your past experience) ?
Have you had cases where a sponsor had a lower then the minimum final
requirement as listed on the web link above and still managed to sponsor his
wife over, or also had cases where a sponsor was rejected due to lower then
minimum financial requirements?

In regards to the criminal record check (as mentioned previously, she was a
student and was working in Canada on visas a few years back), I just spoke
to a RCMP officer over the phone and he said that they would not issue a
background check for PR Visa unless a client number is given from
immigration Canada?
This seems somewhat confusing as you say that the police certificates must
be included with the applcation, and since a client number will only be
issued once the application has been submitted how is this possible?
Does the RCMP officer not know what he is saying?

In regards to medicals, you say that proof must be submitted with the
application, is the proof (ie. client receipt) the proof that is issued from
the doctor?

Thanks very much again for your help, btw, what immigration consultant
company do you work for in Vancouver as I also reside in the Vancouver lower
mainland area as well?

It doesn't matter as long as you are not collecting social assistance, are
not in default of previous sponsorship or child support payments (if any).

Please download forms and instructions specific for your case (inland or
abroad spousal sponsorship) and read them carefully - most of your questions
will be answered there.
