Urgent Family Class Question: Spouse
Hi
I am engaged to marry a canadian PR and we will be getting married
soon.
I am living in the US with no legal status and working here. My
Fiancee is working in Canada. I had applied for PR under independent
category hoping that I would get an interview waiver, but instead I
recieved a call for an interview. (which would probably take another
18months or so to process)
I have to move to Canada sooner to be with my fiance as soon as
possible, so we have decided to get married sooner than earlier
thought and apply for spouse sponsorship.
My question is
1.Will my "no legal status" in the US cause my spouse application to
be rejected. ( I have noticed in the CIC guide that you could write no
legal status in the background declaration form..does that mean they
are okay with it or they are indifferent to the applicants legal
status in the country of application. I had not supplied any
documentation to my status while applying as an independent and my
application was not rejected.. can I be hopeful here too..)
2. Also will my pending independent category application have a
negative effect on my spouse application.
3. Also what is general timeframe for a spousal visa to get processed
in the US.
I would appreciate any help in this regard..

Your no legal status in the uSA should not affect your application for
PR. Despite what others may say CIC has not implimented the legal
status requirements of the new law.

It should have no effect.

Spousal cases are supposed to be processed in 6 months but there is
slippage if you come from some problem countries particularly the
middle east. If yo are required to attend an interview you may also
encounter delays and therefore careful preparation of the application
and a history of yru relationship are essential.
