Unreceived application in Buffalo
Dear Experts
I have sent all my applications/ papers and documents to the Buffalo consulate in May
2001 . On July I called them and spoke to a lady and asked if they have received my
paspers and application she said yes but it did not take a tracking number in their
system; so I asked her if I can change my correspondence address and she took the new
address. After long waiting I called in October 2001 again to my surpurise the
officer told me that No we do not have anything regarding You except the request to
change the address.
My Question is I have collected all the papers again (experience certificates births
cert. etc .........)
My Question is Do I qualify under the old law or under the new law if I resend all
the required papers again ??? and how can I call the canadian consulate in Buffalo to
ask them again about my status as I am now outside the US

If Buffalo doesn't have your application then sending it now will not get you under
old law, sorry. More - if you are not in US (looks like you are in Egypt) then don't
submit your application to Buffalo anymore.

old law, sorry. More - if you are not in US (looks like you are in Egypt) then don't

I have heard from department officials that they do not intend to implement (use) the
provisions for filing in country of habitual residence at this time but want it in
the regs so they can in future. (This was March 2002 info)
Do you have any updated info?

No Berto, I know as much as you at this point about the requirement to file
application within the jurisdiction.
But it has been also clearly indicated to me that even if this requirement is to be
scrapped for now it will most likely not change the policy of mandatory interviews
for cases submitted from outside the jurisdiction, so submitting application to the
visa post responsible for applicant's country of habitual residence will still be the
best option.

Well could be for most. But there are some cases that people could really take
advantage of better posts (if able to go for interview) but also those who are
studying or working outside their country of habitual residence.
