Temporary work visa under Nafta
I hope you can help me. I am a US citizen who has worked for my current
company, an international retail chain, for over 1 year. I am an Associate
manager who reports to the General Manager. I supervise 40+ employees and train
and develop 3 entry level management staff. I am responsible for all store
operations and human resources. My background includes 23+ years experience but
no college degree. I have skills that are specific to this company.
I have been offered a position in Canada. Do I qualify under Nafta management
or specialized knowlege class as an intra-company transfer? Any suggestions?

No, you do not qualify under NAFTA. The NAFTA Category you refer to is
Management Consultant whose job is to advise and train existing
managment in areas of management ... i.e. time and methods studies,
outplacement organisation, benefits consultancy and so on. A management
consultant does not in any sense of the word "manage".
You'll have to look at something else like intra-company transfer.

No, you do not qualify under NAFTA. The NAFTA Category you refer to is
Management Consultant whose job is to advise and train existing
managment in areas of management ... i.e. time and methods studies,
outplacement organisation, benefits consultancy and so on. A management
consultant does not in any sense of the word "manage".
You'll have to look at something else like intra-company transfer.

Thank you! From what I have read, Intra-company transfers fall under Nafta
according to the CIC website and phone calls I have made to their office. I
just need to find out if I qualify for an intra-company transfer before going
to the POE as a management transfer based on my title and qualifications.

Beg pardon, you're right ... Canada included intra-company transfers
under NAFTA to match the US L visas which existed in their own right
prior to NAFTA. I was looking at NAFTA Professionals categories in
makng my statement.

Beg pardon, you're right ... Canada included intra-company transfers
under NAFTA to match the US L visas which existed in their own right

if you have the authority to hire and fire or recommend other
supervisory staff, as well as other, personnel actions (such as
promotion and leave authorization).
Otherwise, the extent of the specialized knowledge that you have would
have to be explored in greater detail.
