Default Staying outside Canada

Hello Andrew

I have one question regarding staying outside Canada.

I landed in Canada in June 2003, completed all the formalities (Sin
Card ,licence and medial Card)etc andin July 2003 I got my PR card and
after getting the PR card(within a 3-4 days) I flew to my home country
and
I am in my home country since July 2003 and might have to stay until
April -May 2004 .

Now my question is ,how long can I stay outside Canada at a strecth.
As I am a new PR (stayed in Canada for a month only) , I am little
concerned
that If I stay outside of Canada for a longer period of time (like
let's say a year or so) ,I might have some problems while entring when
I will go back in April or May 2004.

I hope there is no clause or anything that applies to New Immigrant
for time spent outside of Canada

Can you please clarify what does the law states and how long can I
stay outside canada ?

You will be OK one can stay out of Canada 3 years in any 5 years

There is no law saying how long PR can stay outside Canada. But we have a
law saying how long PR must reside in Canada to maintain status. It is
called Immigration and Refugee Protection Act (IRPA) and section 28 of IRPA
deals with your question.

and I cant go back to Canada?

Please read section 28 of IRPA and see what is required to maintain status.

You need to be 2 years in Canada in any 5 years to maintain PR status so simply it means you can be out of Canada for 3 years in any 5 years. Don’t get confused you have not lost PR status and you are Ok to come back

Don't listen to Andrew. He is dead wrong when he said there's no law
saying how long a PR can stay outside of Canada. The law says not
more than 3 years out of the consecutive 5 years. In other words you
must spend 2 years in canda out of 5 consecutive years. Andrew I
suggest you don't confused people.

Read the law. Law clearly states how long PR must be present in Canada
to maintain PR status. Law says absolutely nothing about how long PR
can be outside Canada. If you are so smart ass then show us in the law
where it is written what you claim is.
