Spouse Sponsorship Question
Hi there,
I am from Vancouver and I am a Canadian Citizen. I have a fiance from
Singapore and we are planning to get married next year. She is
currently living in Singapore but she might be studying here in
Vancouver as an overseas student in Sept 2004 if she is accepted into
the college. I have a few questions that need some advise.
1. If we get married before Sept 2004, and submit the application for
her to become a PR (assuming the application will not be completed
before Sept 2004), will the PR application interfere with her
application to get a student VISA to get into school in September?
2. If she enters Vancouver on a visiting status and we get married
here in Vancouver, can we apply for her PR as an inland applicant and
have her stay in Vancouver while the application is being processed?
3. Assuming all medical checks pass, and no extra issues with the
application, how long does it usually take for the application process
to complete and a PR status be granted?
4. Which is the quicker appliaction process: inland application or
out-of-country application?

That is always a possibility, there is a legal definition of dual
intent wihere a person has an intent to be a visitor and immigrant at
the same time, unfortunately not many visa officers are prepared to
accept dual intent and remember as a visitor she has to satisfy the
visa officer that she is going to Canada for a mere temporary and
special purpose and will leave at the end of her authorized stay and
at the same time she has an immigrant visa is process. Difficult but
no impossible very much depends on the attitude of the visa officer.

Yes, if she comes as a student and subsequently gets married you can
apply for permanent residence as an inland applicant. The issue of
whether she will be allowed to stay is a factor that is determined by
the immigration officer at cpc Vegreville based on the bonafides of
the marriage.

Remember an average is simply that an average, 50% of the cases take
longer and 50% of the cases take more time. At the moment we have a
lot of inland cases going and the average is about 11 months from the
time the application is submitted to Vegreville, the process overseas
is much quicker for some reason.(perhaps they want people to apply
abroad)

No question, if there are no problems associated with the application
a case filed abroad should generally be concluded a lot faster than in
Canada.
