Hi!
I am engaged with an Canadian citizen. I live in US without a legal status. We want
to marry but we don't know if we can apply within US or is necessary to go back in my
country and apply for spousal/fiancee sponsorship from there. I am afraid to go to
ask that question directly to canadian consulate officials, so , if somebody know the
answer, please help me. What choices do we have!
Thank you!
Antonela B.

Wow. This is debatable. If you are at variance with law then technically you should
disclose this in the application. Now, would this constitute a bar?
See IMM application questionnaire " Have you ever been............."

You may submit the application in the USA as long as you will be able to attend an
interview therein.
Canadian policy has been to ignore an applicant's foreign immigration status.
However, there have been some refusals on the grounds of criminal inadmissibility
where the applicant admitted to having knowingly violated the immigration laws of a
foreign jurisdiction.
