Same-Sex immigration situation- under H & C

Default Same-Sex immigration situation- under H & C

Hi,

I have some questions regarding immigration, and also some information
need to be clarified.
My partner is a Canadian citizen, and I am from Taiwan.
I sent my application as independent skill worker, but under H&C to
Buffalo on May 13, 2002.
Finally, I got a response from immigration Canada on November 11,
2002.(a receive, and a letter with my file number)
As it said, i quote, 'Yor file has been placed in a queue awaiting
assessment. You will receive the results of this assessment along with
additional information ans instructions within the next 52 weeks. At
that time, you may also receive medical forms with instructions.
Unfortunately, we cannot reapond to requests for the status of your
application within this 52 week period.'

Does it mean that I cannot do anything, but wait for their other
respond at least 52 weeks? Or what can I do?

I learned from my friend, who is also a sponsorship with his partner
from Thailand. He also told me that I probably can apply again within
Canada under common-law sponsorships. He said that he heard about a
case from his immigration consultant that a person applied again
within Canada under common-law sponsorships.
Is it possible that I can do that? 'cause I am live with my partner in
Toronto right now.

Is there no more Buffalo Office after Jusn 28th, 2002? what's going on
for those cases which sent to Buffalo?

Before, I knew this process will take a long time, so that my partner
and I just wait. Now, we heard a lot of different stories from our
friends, we start to worry!!! I keep think about that all the time,
and even have nightmares. I'm in a desperate situation and need your
help!

I do appreciate that if you can answer my questions, and give me more
information in terms of same-sex immigration right now.

We live in periods of time during
May to August, 2001(Canada),
October 2001 to January 2002(Taiwan),
May 13 2002 sent out my application,
June 2 2002 to March 28 2003.(Canada),And April 18 to present.
I went to Taiwan for around 2 weeks visiting my family, then came back
to Canada on April 16 2003. (April 16 - April 18, I visited my friend
in Vancouver, then I came to Toronto on April 18)

It may be a good idea to withdraw the application and apply as common-law
partner from within Canada, providing that you live together for at least 12
months already.

Do what Mr.Miller says but this time marry him. I just heard in the news that they are going to accept same sex marriage. It may help you to do a little research.

Really? I can do that? I mean, to withdraw the application and apply
again?
Do I need to pay the application fee this time?
How's the procedure? and where can I get the information about that?
Can you advice me, please?
How can I provide that me and my partner live together for at least 12
months already? Can a joint bank account and a mailing bill with our
names on it count? receipts from our landlord? letters from our
friends? or??

Yes, new fees will have to be paid. For the procedure look here:

http://www.cic.gc.ca/english/applications/spouse.html

Joint bank account and credit card(s), utility bills in both names (for
example hydro in one partner's name while cable and phone in the other's
name for the same address), lease agreement, statements from family and
friends as well as statutory declaration of common-law union (part of
application kit), etc. - these would be documents needed to prove that you
are living together.

I did went to Toronto legit meeting months ago, but I didn't really
get the infomation I need from there, espicially after the law changed
on June 2002.
