Question for Andrew Miller: Parents on TRV applying for PR

Default Question for Andrew Miller: Parents on TRV applying for PR

Hi, Miller:

My parents are in Canada on TRVs. If they apply for PR under family
class at buffalo, will there be any problems with their stay in Canada
while waiting for approval regardless of interview in USA? Someone say
that PR has to be applied for from one's residency country. But others
say it is not necessary. I know TRV and its extension are for
temporary stay in Canada each for 6 months only. Nowsdays PR process
takes long time. Will my parents have differenties in legally staying
in Canada when their application is in prosess? And how likely a
interview is required for sponsored parent application at Buffalo?
After Canada changed immigration Act and regulation things get
confusing.

Your parents are not lawfully admitted to Canada for at least 12 months, so
they cannot apply through Buffalo. Depending from your parents' nationality
process may take much longer than a year and sooner or later you'll face
extreme problems with extending their visitor visas anyway. It is strongly
advised to apply through the visa post normally processing applications from
your parents' country of residence/nationality. As you can see in last few
weeks there are several posts from those who tried Buffalo route in Family
class, were required to attend the interview and not being able to obtain US
visa they were forced to transfer their files to home country, thus starting
the process from the scratch. If you hoped that Buffalo would process your
parents' case faster that visa post in their home country then you are
mistaken.

Please note that you must reside in Canada in order to sponsor your parents...

I do not understand your first stentence. My parents are from China
and they are already in Canada on TRVs. From when aren't they admitted
to Canada for at least 12 months?

If they are on TRV then they were admitted to Canada as visitors at the port of
entry for a maximum of 6 months or less, so they don't meet 12 months lawful
admission requirement.

When they have been in Canada for 12 months, lawfully.
