Default Police check for someone who has been in Canada since age 17

Hi Guys,

I thought i would never have to look at Immigration again but here goes.

I am sponsoring my spouse via outland in to Canada from China, we just received a letter from the Consulate saying they need a police Cert for every country in which you have been resident in for 6 months or longer since the age of 18, provide a police Cert for China

Well my partner moved to Canada on a study permit at age 17, everywhere i have read they don't require it for time under age 18, so confused now, do you think this is an error from CIC ? or do we really need to get chinese police Cert ? and another one for Canada( which i thought was done automatically )

Thanks everyone??? having a meltdown here

Has he lived for more than 6 months in China, if so then yes he does need a police certificate as requested, he shouldn't need one for Canada, however the experts will be along shortly.

he's only ever been back to china twice, and that was for 2 months at a time.

I think technically it's not needed, however if it isn't too difficult to obtain then I would suggest getting it. Better to submit too much than not enough.

If he only spent two months in China twice then no, the certificate is not needed. It's six consecutive months, not six cumulative months... and he doesn't even have six cumulative months anyway.

It is at the Visa Office/Officer's discretion to ask for any specific document it would like to see. It seems to me from what has been written that a specific document request has been made. Up to you whether you will decide to clarify (with the Officer) or comply.

I misread the original request. If CIC is explicitly asking for a police check from China, then yes, provide it. CIC does sometimes request extra certificates even for periods less than 6 months.

Not quite true from the CIC website
You may need a police certificate from any country or territory that you have spent six months or more since the age of 18.

For example: if you visited, worked or lived in a country for two months, left for a few years, then returned for four months, that counts as spending six months there. In this case, you would need a certificate.
