Please help me clarify my situation.

Here are my details :

Me and my wife are Canadian PR's and are in USA for the past 15 months on H visa, we
do not have an RRP. We need to travel to India to attend a marriage.

Will I be able to come to U.S back based my PR papers in passport, I am a citizen of
India, (commonwealth country).

or

Should I apply for multiple entry visa while I am in India, I am concerned that they
might not issue visa bcoz canadian pr's dont need visa to enter US , atleast that is
what the US consulate said before we moved to US.

Please Share your thoughts

The bigger problem is that you appear to have abandoned Canada as your place of
residence if in fact you ever lived here. I am afraid that you cannot have it the way
you want it.

I am sorry, I think you misunderstood me, Iwas in Canada for 15 months,before I moved
to US. I am willing to surrender my Canadian PR, But I am not sure how to, the
physical presence of the landing papers on my Passport might make the US consulate
office in Madras(india) might lead them not it issue multiple entry H1 Visa as PR's
Dont need one.

I Hope my situatation is clear.

In other words the bottom-line is "Entering USA" when returning from India.

First of all you need to have 'Multiple-Entry Stamp' on your H1-B visa (if your
wife has a H1-B or H4, it also needs one). From your posting you don't have one,
and doubtful about not being issued one because of landing stamp of Canada in
the passport.

As far as my knowledge goes, the consulate in Chennai don't care what country stamps
you have while applying for 'Multiple-Entry'. They only see if you are currently
posses a H1-B visa, currently employed and in legal status. Multiple-Entry is based
on your current & valid H1-B and not based on your travel or immigration to any other
countries record. So, carry
1. Letter from employer stating the need of multiple-entry (coz, you travel overseas
on business)
2. Letter from attorney standing as a reference for you
3. All your prev H1-B approval notices
4. and other fee and passports of course

I'm not a lawyer or expert. Just sharing what I heard/read.

You are no longer Canadian PRs in all probability. Any attempt to re-enter Canada as
a Canadian PR will result in a Ministerial review and probable revocation of your
Canadian status because you have failed to retain active residence in Canada.

Your H status in the USA is not dependent on your being Canadian PRs ... it is issued
to you as an Indian citizen. Only your entry without a passport visa is granted to
you on the basis of your Canadian PR status. You will need a visa stamped into your
passports before returning to the USA because you are no longer a Canadian PR.
