PLEASE Help!!!

Default PLEASE Help!!!

Hi guys,

My partner and I have been here since the beginning when we first applied for TWP and that was over a year ago now.....If we encountered any problem along the way we just go here and search for the answers!!! This forum has helped us a lot!!!!

Now, TWP is over and PR is our next step....Everything's ready as my partner has been nominated as a Provincial Nominee, we're just about to send our stuff in the post then a phone call from UK. It was ACPO, my heart sank while I was talking with the guy!!

Thing is, they have found 2 minor convictions on my record one in 1981 and 1987...Now I know this has been discussed in the forum over and over again but please let me continue....

The thing is we had our Police clearances done in January for TWP and both came back as No Trace!!

So what's going on??!! When we applied for TWP, we waited for our police clearances to be able to decide as to whether or not to declare any offenses. As it was a No Trace, and I have sought for advice from people, we thought that my record is clear as this had happened 22 years ago, so there's nothing to declare.

So now, what should I do?

Application for TWP, we declared no convictions and now with the PR application with the offenses and all...CIC may find us inadmissable because we declared no convictions in the first application...


Anyone who can help....please feel free to share your thoughts!!!

When you got the Police checks last year, did you get the old subject access under data protection ones....coz they usually show up more than the new ACPO ones. The new ACPO ones do not usually show any convictions which are now deemed spent.

I would have thought that you could take some advice from ACPO
The number I have for them is 0845 60 13 999......they may be able to tell you about rehabilitation of offenders and the time scales for convictions being spent.

You didn't say what the minor offences were, and I don't need to know, but if you commited them as a juvenile they may not affect you after such a long time of being 'good'

If you don't get the answers there, then ask advice of CHC.

Why did you say no convictions if you'd been convicted twice?
People dont usually "forget" if they've been convicted of something... not unless it's an everyday occurrence.

I would have declared the convictions in the first place and when the Police cert came back without any, I would have put in a covering letter explaining when and what your convictions were. The fact that you did not disclose them then and have now been found to have some, which you knew in any case, casts very serious doubt on your integrity. CHC can then take the view, if they choose, to doubt the integrity of your entire application.

This 'hiding' of material facts which can only have been intentional on your part....could jeopardise your application. At the very least you need to be taking some case specific advice from CHC to get this matter fully aired, if they will now let you.
I do wish you luck and will keep everything crossed that you can get this sorted out.
