My wife got denied,HELP!!!

Default My wife got denied,HELP!!!

I can't believe Immigration is so insensitive. My wife just got her papers
yesterday telling her that she has been denied. The immigration officer for
some obscure reason thinks that my wife has another purpose to come to
Canada. This is simply ridiculus . I am the sponsor and have not yet
recieved the letter(I am so freakin' mad right now) yet telling me the same.
Can someone please advise on what I am to do next. How do I go about appeal?
This is so stupid.Being apart all this time( 11 months) and money spent and
then you get an answer like that. I am crushed. Please help!!!

You will receive a notification from the visa post together with instruction
on the appeal process. I suggest you seek counsel from a competent person
with experience in these matters. It will take from 6 to 12 months to
resolve the issues. Alternatively look up www.irb.gc.ca for more info on the
process

Denied what? If her application for inland PR process has been denied then
she must apply abroad. It doesn't mean that she must leave Canada as long as
she keeps her visitor status valid. Appealing this will take longer than
just going through the PR process abroad.

If your wife has received the refusal letter and you are waiting to
get a copy you will have to follow Jim's reply as it is obviously not
an in Canada case or you would received the response together. This is
clearly an overseas refusal and now you have to determine the resason
for the refusal and perhaps obtain a copy of the CAIPS notes and then
determine if the application can be rehabiltated with the filing of a
new application and overcoming the grounds of refusal, if not then you
have to pursue the appeal route to the IAD.

The most likely reason for denial of this type is that this is a marriage
for convenience. If I may hazard a guess, you two got married in China
while you were a Canadian resident. Obviously, you didn't prove your
relationship to the satisfaction of the visa officer.

Read Regulation 4 - Bad Faith. This will be the gounds for refusal. I also
suggest you read it in the French version of the regulations which has a
subtle but important difference in wording.
