Dear Mr. Miller,

My name is Sri. I have posted here many a times. My profile

Nationality : Indian
Applied: May 2002 (was pursuing my Masters in Computers there in
Winnipeg )
Current Status : Done medicals / finger printing in Oct 2003. waiting
for PP req.
Visa office : Buffalo


My question :

I sent my package to Buffalo office and was going through the grind,
now as expld waiting for PP request. I am wondering may I change my
office from Buffalo to New Delhi, India at this point (as i am
currently in India now)

You may ask Buffalo to transfer your file to New Delhi, but your request may
or may not be granted at Buffalo's discretion.

If you are waiting just for passport request then try to arrange for
passport to be taken out of India and then mailed to Buffalo with returning
address in Canada or US only. And then arrange again to have it brought back
to India.

Asking for transfer of file after final decision is made is not recommended
as visa can only be issued by visa post processing application. You may end
up having your case re-assessed by New Delhi and if unlucky you may not meet
pass mark which will be in place at that time.

So, try harder to arrange for your passport being sent to and out of Buffalo
without breaking Indian law. And remember that Buffalo will send passport
back only to Canadian or US address.

So, can we assume that Buffalo doesnt care about valid status in the US (at
the stage of visa issue)?? If a passport is sent from India to US
the,,,,passport may or may not have a US visa.

You can assume that if you are no longer in the US at visa issuance, that is
not a problem.

A valid visa on the passport doesn't always prove valid status in the US.
It is the I-94, rather than the visa stamp, that proves valid status.
A person can have a passport visa stamp that expired 5 years ago, yet still
be in perfectly valid status.

Thus, CHC Buffalo doesn't have a way of knowing whether a person is valid in
the US or not simply by looking at the passport, unless they cross-check
with the US-BCIS about the person's status.

So the strategy suggested by Andrew will work.
